FOA Tia ( AQHA papers)

It was ApHCC not AQHA I'm afraid. However I'd think they are probably the same; there was nothing about NOT putting the horse in the childs name, hence I did go ahead and register Cruise in Meg's name.

Well a 17 year old girl wants to buy Tex. She wants to do everything in her name as she is paying for the horse and works off her horse board herself.


I am wondering though about her being underage and about the legality of the transfer and sale.




Should I have her mother sign the sale agreement? A 17 yr old signing would not be binding if there were any problems down the line.
 
So if it isn't binding then the horse simply goes back to being owned by you if anything goes wrong surely?

As to working off board, I'd have a contract and have the mother and daughter sign it.

I've never been able to find anything saying that underagers can't be the legal owner of a horse within these societies to be honest. Why don't you quickly drop AQHA an email - they are usually really good at replying.

I am not boarding him for her! NO WAY! Not a situation I would like to be in nor am I set up for it. She is working off her board for her current horse where she lives and will be giving that horse to her sister and taking on Tex.

I want a sale agreement signed as I do with all horses I have sold. Just a piece of paper stating that all sales are final and no refunds will be issued if the horse turns out not to be what they want after buying or they change thier minds.

Think of what happened to Patches friend for example. I always want this signed at a sale. I will give every opportunity for them to try a horse and I am very honest. I also would allow anyone to have a vet look at my horses before they buy. I think that is enough to offer so refunds are not an option.

I know people though and I would not want some lunatic injuring a horse a week after they get it from me and come back to me saying that horse was lame etc.

This is America...they will sue you for anything. Get it ALL in writing
 
A Bill of Sale is not the same as Registration Papers. Registration Papers are legally binding, a Bill of Sale isn't, it's just a piece of paper.

I was initially asking about registration papers and minors and I am going to give the AQHA a call to ask for sure.
I also got to thinking and the convo evolved to questions about the entire legality of a sale to a minor and if you have to have an adult involved. Never sold a horse to a minor before.

If I drew up a contract for a sale agreement and an adult signed why would it not be legally binding? If it isn't I am sure it would help not harm in a court room situation. Certainly makes me feel better anyhow.
