Funny Hi Viz jackets......

ok, i've searched, searched and searched some more on Lexis Library (a legal search website where you can find previous cases to find precedent, rulings etc etc) and I have not found a single case whereby someone admitted liability for the wording on their hi-viz.

did find an interesting case whereby a guy was riding in London, the horse bolted and knock someone over on the pavement who unfortunately died 3 days later in hospital. They found that the rider was not negligent and therefore innocent.

Also, found various cases of 'Car Insurance' companies vs. owners and horse insurance companies. They tend to go one of two ways, either 50/50 or car driver at fault. Hi-viz was mentioned, even the Warning and Caution ones, but didn't go against the rider/horse insurance.
 
c2b someone said about putting an L plate on there bib. I dont know if that would be allowed or not. As if your out hacking alone with a L flag on then maybe you could be seen as not being safe to be out alone??

Which is why I deliberately put motorcyclists not just motorists. Motorcyclists go out alone with an L plate on.
Please pass wide and slow is just saying what the highway code says. How is that admitting liability?
I don't know the answers just pondering lol.
 
Does this mean if I see a road sign warning of hazards, I can crash my car and then sue the council for accepting the road is unsafe, advertising the road is unsafe, but failing to do anything about it?

FTR - I have "Caution, Lady Rider with PMT!" on mine. Because if someone hits my horse, they will have about 20 years worth of PMT rained down on them in one go!

Where does the law stand on other warnings? Do the parents of these kids I've seen in t-shirts that say "I have autism, please excuse my strange behaviour" accept their children shouldn't be taken out in public?

Sorry if I sound harsh, but this is akin to a rapist saying well guv she had a short skirt on so she was obviously advertising herself... It's words. Just words, nothing more nothing less. A motorist can choose to heed the warning, or they can ignore it. If a horse is unsafe to be on the road, then that's liable however words on a vest don't cause people to drive dangerously....

It would be ridiculous to sue someone for wearing a t shirt that was offensive, I don't see how people can say OBVIOUSLY the horse caused the problem, she had a vest on that said please pass wide and slow....

Some things are too ridiculous for words! It really winds me up!

Um... If I went out riding in a hi-viz that says "crash into me, my horse loves it" possibly that would be inflammatory

But it is ridiculous. I'm going to find a ridiculous one on Sat, hack out in it and post a pic... I DARE my insurance company to cancel!!! :D
 
Me and hubby getting in to doing tack sales and decided to do some jazzed up hi viz - i've got lovely pink one with prismatic horse shape on back and small diamonte diamonte on front - so practical but looks pretty and no problems with any dodgy wording:p
 
How about a massive inflatable high viz bumper for your horse that is 3 foot wide! Not sure about going through the bridlepath gates tho? hmmmmmmm
 
I was told this worry about the caution wird was just an urban myth which is why I have a "Caution Mule and rider" one
 
The issue is the animals act. If you know that your animal has a propensity to a certain behaviour you will be liable. A statement on a vest could be considered as evidence that you are aware of that behaviour, however there isn't case law on this yet.
Caution horse and rider or please pass wide and slow should be fine. But caution young horse could be seen as evidence that you are aware your horse is not fit to be on the road, likewise an L plate or similar statements.

Personally I think that the humorous ones give the wrong impression and wouldn't reflect well in the event of an incident.

A plain tabbard is the safest bet though.
 
Has anyone seen the one with a picture of a horse and rider in a pond saying "Should have bought a 'Sat Nag'"?

I am so tempted to have one made up with a picture of a car v horse collision - if anything will make motorists back off it should be that!
 
I was told this at olympia last year. Went to the V-Bandz stand asking for one that said caution horse in training, or something to that effect, and they told me they dont stock them. Apprantly if an accident occured, you would be more liable if it was picked up on. I asked my insurers this and they said they hadn't heard of any cases, but if someone was looking to wriggle out of a claim then it would certainly be thrown into the pot.

Same as if someone breaks into your house, you have warning gaurd dogs signs up, the dog bites them, and they can sue! Not where I live they can't:D Mind, the dog does get locked down on rabies watch for 10 days. Come on my property uninvited, get bitten, tough. It is called trespassing here. If you are stealing my livestock (therefore depriving me of my livelihood) apparently I can shoot you too

Also got told the same when we had people breaking into the yard, we wanted to put up signs with warning horses are dangerous, but the police advised us not to, crazy really!! Heard that one too, simply put [I]"Please stay away from the horses"[/I] that puts the onus on the one that gets bitten/kicked/knocked over, not you. Likewise you should not put "I bite/may bite" on doors. I was advised to put "I can be grumpy, please leave me in peace" it warns but doesn't specify

My signs simply say "Private Property" and "No Hunting" there is no right of access in my Municipality, legally, if you are not invited, you are trespassing -simple.
 
Hmm some may think it's funny but I think you have to be careful with the messages on your hi-vis. If you want motorists to take care and treat you with respect, stick to something bland like 'please pass wide and slow' or simply 'caution'. Daft slogans just irritate people in my experience and send out the message you aren't taking it seriously.
