I have a husband and wife who do jobs for me on my yard and there is a spare bit of unused land that they have asked if they could have for an allotment.( They are avid viewers of River Cottage ) In principle I have no objections as they are a really nice couple and it would get the plot cleared and maintained without me having to pay someone. But do I need to consider anything formally.

Anyone else given over any land for allotment use.

I think that's a good way of saying thank you for helping out on your yard with jobs. As long as they understand that they only have the use of the land, they have no rights of ownership then I don't see any problem.

Sounds like a nice idea for them.

In a similar vein ... I bought a house where previous neighbours had put a gate between the fences at the back. This gate had bben there so long, that it was classed as a right of way and couldn't be removed. This came into effect after either 7 or 12 yrs, I can't remember.

It may be worth spaeking to a solicitor to see if they would have any claim over the land if they had it for a certain length of time.

Make sure you have a formal agreement set up stating rent - how much and when, limitations such as no animals etc and notice period etc. You don't want to find a few years down the line they have a legal claim on the land.

The is or was an old law that if you maintained some land and paid no rent after 10 years you could claim it. You need to check this out just in case. I'm sure they wouldn't but better safe than sorry even if it's only 1p a year?

Thank you both very much those web sites have been very useful.
What started out as a mutually beneficial idea now seems to be steeped in contracts etc to be on the safe side.
