I'm Utterly speechless, have received notification from a livery yard that they intend to pursue debts incurred by my horse's loaner against ME! Apart from being utterly furious, I'm rather upset, surely they haven't a hope? The 'legal' letter cites me as the owner of the horse, altought I had no contract with the lvery yard.
I know that this is rubbish but it just amazes me what lengths somebody will go to for £50!! My OH suggests just paying them to keep maters quiet, however my sense of what is right is shouting at me to tell this man to get st***ed.

Why oh why do horses attract such grief!

I wouldnt pay it out or princeable!
If your names not registered on the pass port they then they cant accuse you or owning the horse!
Who are these ppl, are they a company or just an indivdual.
Have you spoken to the owner?

I think OP is the owner, who had her horse out on loan, loanee did not pay livery bills and yard owner is looking to get the money out of OP.

I am not a lawyer, but I can't imagine how they have a leg to stand on unless the loanee terminated the contract, let you know and expected you to be responsible for expenses (which doesn't seem to be the case!).

Tell him where to shove it. How on earth can they prove ownership? Answer - they can't. You signed no contract with the livery yard therefore under contract law, they cannot prove that you owe them any money whatsoever. Contract law is very clear about it.

It's got nothing to do with ownership!!
The loanee took out a livery contract. The contract is between her and YO, and has nothing to do with whoever owns the horse.

The bill is not your problem.
Mind you if someone had my horse on loan and they were not paying bills for its keep I may go and get it back !

Are you a BHS member? if so ring them for advise. Do you have a loan contract with the laonee stating who is responsible for what? If you do not then I think you may be liable for the debt as the horse owner.

I'd be more worried about the horse than the £50, if they can't pay the livery how can they pay to care for the horse?

How do you know that she can't pay the livery bill ?

For all you know she may've had to up sticks and leave the yard due to them not looking after the horse properly (or a whole host of reasons) and this may be the YO wanting payment (of notice) which the loanee doesn't think reasonable? There's always two sides to every story so don't jump to conclusions!

The livery agreement was between loaner and YO, so the YO can't and shouldn't be chasing you for the debt, as it's the loaners debt not yours.

I dont think tis is quite as simple as the previous posts sugest. As the owner of the animal, you have entered into an agreement with the sharer, presumably agreeing as to how and where the horse will be kept, and who pays what. This agreement is of no concern to the YO. You own the horse. In the cicumstances I would claim against the owner if the sharer defaulted. It then remains for the owner to cross claim against the sharer.
