My fullest sympathies to all concerned.
I would suggest that the owners of the horse take a 'private civil, action' against the driver once the police have decided or not decided to prosecute the driver.

Hmmm I suppose they will use the 'leaking' of the drivers name as a 'reason' not to prosecute as well
