I need advice on how to deal with the problems my old horse is causing the new buyer. I sold him on good faith and had advised the new owner of his downfalls and i was told that it wasnt a problem, they had kept a part bred arab before and that he would be in the hands of a novicy but not inexperienced rider, who would have lessons to rectify this. As a seller where do I stand with the problems that have arisen since the sale 12 weeks ago, some of which i never experienced, having owned him for a long time?

Im assuming what you are saying is they are accusing you of lying about the horse, and saying that you made out he was quieter than he is?

Well, do they still want him?

If not, and you want him back, buy him back?

You will have to explain more ithink because you dont say what problems they are having.

Are we talking about not giving basic care, or just the riding side?

If you care about the horse have it back or goodness knows what will happen to it.
If you are a dealer then they have more of a case against you than if you are a private owner ,as you seem.I would just worry about the horse,if you had him a long time you must care about him.
Are you able to go over and see the problem and help them with it?

Grrr how maddening, they obviously aren't fit to have this horse.

I guess you'll have to try to have him back, maybe they'll loan him back if you can't pay yet, and you pay in installments?

This annoys me too. You were totally honest and it sounds like theyve taken on too much and the problems are now escalating, so they get back in touch with you. God dont they realise they are the cause. Grrrrr !!!!!
I really feel for you. Is there any chance you could go up, watch them ride and advise them.

blimey you poor thing - what a difficult situation. I was on the other end - i bought - but from a dealer and i had to find out about the comebacks. I was deliberatly mis sold something so is different. When i spoke to the someone at the trade descrptions act - although they werent horsey - they said that you have more of a come back on a dealer as you are covered by the sale of goods act- the horse has to be fit for purpose and as described - as a private seller you dont have to meet this. Do you have a copy of the advert that you sold him from - did you mention the issues in there that might help? I guess it comes down to whether you want him back or not really at the end of the day tho. Good luck I hope it works out for both of you.

No, dont have him back as they have caused the 'new ' problems...as they started after you sold him, i thnik they may be regreting buying him and now putting the blame on you, peeps always look for someone to blame except themselves, when things go wrong or not to plan. Stand your ground i say.

This exact same thing happened to me. I bought my horse from a dealer I knew well, and they mis-described him - told me he was a safe 9 year old allrounder, who'd been used in a riding school for novices, that had been there and done that. Turns out he's nearer 7 and terrified of hacking or competing alone, and rears. Hmmm... I'm experienced, but even i wasn't sure i could deal with that! Tried to send him back and contacted Trading Standards, very helpful and said we had a good case, but we didn't want to go to court. Thankfully, we stuck with him and after lots of hard work he's really improving.
You sound like you've advertised yours truthfully tho, and the new owners are just too novice. If you care a lot about the horse, buy him back, or let them sort it out. If it developed the problems with the new owners, then its their issue, not yours.

They have had him 12 weeks - that is 3 months, not 1 month, so obviously any problems they are having are caused by them.
If he wasn't suitable why didn't they get in touch earlier?

You COULD buy him back, at a much reduced price, to put right what they have caused.

First I would go over and see exactly what they are doing wrong.
Sounds like they are trying to get their money back. Perhaps they are feeding him incorrectly, or keeping him in a way he doesn't like.

About 3 years ago i sold my mare who was 14, and i had owned her scince a foal to a lady who wanted to hack and lightly compete her, this mare was 100% bombproof and numpty proof in my opinion! well after she had had her for about 6 weeks i had a phone call saying she was having a few problems... apparently the mare was trying to buck her off and had reversed into a wall out hacking and was lively! I went straight over tacked her up and went on the route which the lady had had problems on, she was absolutely perfect for me, i got off her and lady got on, and no word of a lie the old mare had her head down trying to dislodge her!!! I couldnt believe it she had never done behaviour like this in the 14yrs i had known her.. I offered the lady half her money and bought her back, its just very interesting really with a horse sometimes it is really important to fit the right rider with your horse, my mare has not behaved in this way scince returning to me and she has been happily on loan for the last two years with no problems! funny things horses...

Hi guys, thanks for the support out there. I am a private owner, I bought my old horse when I was 13, backed him and turned him away and gradually built him up to novice/medium level although my main aim was showing. Having owned him for 10 years you can understand i was devastated when my work committments changed within a matter of weks and i was left with a stark choice- sell him or lose my job and not pay my mortgage. If i had all the money in the world he would be with me to the end! I told every person who rang from the ad he wasnt a novice ride i vetted them not the other way round........

In total I ruled out about 19 people who I felt were too inexperienced to cope with him. Hes sharp and has presence, but not a loony as i wouldnt have kept a horse who could have killed me for ten years! The person who i sold him too has experience with horses but i fear was economical with the truth when it cme to how good they were with different types of horses. He now rears and doesnt hack or do men - in 12 weeks from selling. I dont understand how this could be unless fundamental points ie feed/environment have been changed even though i advised everything about his lifestyle.
