HELP!! Liveries From Hell!!!

Hi - we have liveries on the yard who have mounted up quite a bill (their horse isn't worth this much), they are due to pay mid Juy when her husband gets paid, but on saturday they tried to move. Since then things have gone from bad to worse, the police and SSPCA have been involved (if i told you the whole story you probably wouldn't even beleive it, oh and we'de be here 'till the middle of next week!)

The police have informed us that as soon as they step onto the yard to call them and that if they would like the horse moved they have to hire a transporter.

We are waiting for the layers to call back so while I waited I thought I'd as you guys if anything like this has happened to you? Do you know if we have rights to keep their trailer?

I would call the Citizens Advice with regards to keeping the trailer.

Do you have a livery agreement?
 
You would need to seek legal advice to get a liean over the trailer, I don't know how easy it is to go about it to be honest. I know a YO that went about it in a less than legal way, just went and took the trailer to repay the debt, the livery was raging but when they realised it was the trailer or legal action to recoup the monies owed they just let her have it. I really hate people that don't pay their debts, they just shouldn't be allowed to own animals if they can't pay for them!

I have heard of welfare/payment disputes with liveries before. YOu did right getting the police and SSPCA involved. Might also be worth getting a solicitor as I have a feeling they might try and pull a swift one on you.

Am not sure about the legality of keeping the trailer, but if they owe you you could hold it as a 'deposit' until they pay up in full.

We know of a livery where someone owed money and they blocked their wagon in with a tractor till they paid. Not a nice situation to be in and they may want to pay before the word "slips" out to other yards that they are bad payers?
 
Oh my goodness!! Be very careful if you are in glasgow we are in ayrshire and most of the yard owners know of them after this and they can't find a place to go so they might try further afield!

We warmed them if they didn't leave now we would have to call the police as the amount of abussive language that was shouted at us so a couple hours after they left the police arrived up and charged myself and my mum with assault and abussive behaviour (there was shouting (no swearing on our part) but no physical contact) and then a half hour after that SSCPA and when we showed her the horse (who under our care won a class at the Royal Highland Show) she just laughed and told us how nice our (newly bhs approved yard) was.

whoooow! not good, if i were you i would ensure that you have a very large lorry or tractor to hand to block your exit in case they try to pull as swift one. it also wouldn't suprise me if they try to take the horse out for a hack or walk it out in the middle of the night to avoid paying. DO NOT let them get away with this, these type of people make my blood boil.

what does your contract with them say?
 
Erm unfortuantley we didn't put anything in our contract about keeping owners horses on liean. Obviously we want the money they owe us but at the same time we really need them off the yard!! I actually think they would go as far as hurting their own horse and saying it was us or something equally sick!! (they have already scattered nails round the school just before i was going into ride my own horse-sorry this is getting rather complicated!) At least the police have told us to give them a call as soon as they appear on the yard so they can remove them.

Oh they sound like bad news esp as they seem to twist everything.

Be careful. Like Josa says block your exit.

Do you have a contract with them?

I hope it all simmers down and everything works out.
 
if they'll scatter nails before you ride your own, what's next?? May be best to let them go and take the loss financially to protect the other horses. Only thing is their poor horse then. . . Citizens Advice sounds best bet so far, or a solicitor, most will do an initial free consult.
 
Yes i know what your saying but we now have police backing- we call them as soon as they arrive on the yard and the poilce will come up and remove them!

I also can't beleive how much of police time os wasted on these people!! They just make me so mad!!

I'm still waiting for the our solicitor to ring me back but hopefully we can just sell their trailor and be done with it!!

It just get worse, nails in the school! Who could deliberately do such a thing. I expect they are hoping they can annoy you enough so they do not have to pay and can go and do this again somewhere else to avoid paying livery bills.

You don't have any 'rights' to it as such, but you are entitled to keep it as (part) payment of the livery fee (you'd have to check if this is the case in Scotland, I know it is down here).

TBH, it doesn't matter whether you have a contract or not, they're clearly not going to abide with anything on it.

I'd get a wheel clamp on that trailer and block the exit - cheeky barstewards. How dare they?

And worst of all, poor poor horse
