Help Needed

I am looking for some advice and some help with a situ.

I have a horse in my care that has been brought 3 yrs ago, the asking price was knocked dwn bcz the horse hadnt been backed or broken and nothing done with him just left in a field, they turned up today with minutes notice damanding to take him back unfortunately cash was paid no reciepts given and they with held his passport when payments were made.

when in their care b4 we brought him home he fell and hurt his back they didnt call out vets to check over so when we went to collect a couple of days later i was faced with a heavy pysio bill back and broken him entered in asponsered ride now they want him back icant prove payment so please some1 where do i stand ive been turned over by them big time
 
Have you had him 3 years? You must have some proof that you paid physio etc and that you had him backed? Also anyone that knew you had bought him that would act as a witness? Not having his passport doesn't mean you don't own him. Write everything you can remember down and contact a good equine lawyer to find out where you stand. when I had to prove ownership to insurance company,I had to provide letter from my vet, farrier,livery owner to say to the best of their belief he belonged to me, I didnt have a receipt from buying him
 
bcz i was advised nt to handover n e more cash bcz of the damage that he got while in their care till 2days b4 we went to collect him, tht was advised by a friend of mine and solicitors i looked into leagal advise so i never paid the maining amounts which isnt even much to loose sleep over plus conviently couldnt find it
 
I would think if you hadn't paid full amount then you don't have ownership and have no rights whatsoever. When you got legal advice did your solicitor write to the vendor telling them you were not going to pay any more or have you just not paid. I would imagine that any contract of sale became invalid the moment you didn't pay the agreed amount.
 
oh rite didnt realise, im still in shock at the moment been in pieces all day bcz of it. didnt know where else to go on a sunday abt it hense y i joined here fir guidence

kitten71, I'm sorry I can't help with the original problem you posted, I don't have any experience in legal matters etc. Just a friendly word of advice though, this is a great forum and there will definately be people who can help you on here but as a rule users on here don't like text language used in posts. It makes many people find it just too difficult to read etc. and then you may not get a reply from someone knowledgeable on the subject because they don't understand the post.

Does this mean you didn't pay the full amount you had agreed, if you didn't then you do not have ownership!
 
thankyou for you assistants anyway though, i do have the added problem of keys sticking all the time have to punch keys really hard to make them work sorry about that.

I will keep a look out for those that might be able too thanks again
 
I'm really sorry but have to admit that my troll-dar is working overtime this weekend. Maybe it's just been too much of a wild weekend on HHO, or maybe a tad too many Baileys on my part.. Do you think we should warn all new people to make sure they spell correctly and use punctuation otherwise we'll be chasing them out of the forum with pitchforks?

yes because the remainding amount wasnt paid on leagal advise, so basicly i'm stuffed although he was damaged still while in their care effectively price was seen leagally asbeing knocked down
 
OP - you said a new price was agreed - did you pay the new price? To be honest if you have had the horse three years and paid money for the horse then regardless of who has the passport the horse is in your ownership, you have emails etc as stated before so the previous owners have no leg to stand on! If this is a genuine post tell them to jog on or you will be calling the police and that they are breaking the law by not passing the passport onto you as they sold a horse without a passport.
