What would you do?

My horse got injured badly on a public road by another horse running loose

The public liability insurance from loose horse paid out for vet treatment and investigations etc

Now it came out that my 21 year old girl which was in excellent health before accident can probably never be ridden again as vet says the lameness won't go away but op wouldn't be fair on the horse as very complicated op and the healing process can be tricky too

Quite emotional for me tbh

I think if you want people to tell you what they would do we need more information.

Seek legal advice, if you are a BHS member call the legal line.
Is your horse insured? If so, get insurance company to persue for loss of use from the third party.
Go back to the third party insurance company for full loss of use claim.

I really wouldn't spill all your side of your story over the internet for others to pick at, until the case is concluded.

I completely agree with this post.
 
You already have an admission of liability because treatment has been paid for by the insurer of the other horse. Send them another bill for the value of your unrideable horse.

I dont think you can expect them to pay for her keep if you choose to keep her alive, but they owe you a replacement value.

If the horse was mine I'm afraid that I would PTS

Horrible situation, I feel for you.

I don't really know what value means in the connection of loss of use as to me no number would be enough she is a one in a million to me ?
 
Your insurance company will deal with this for you.

I'm not sure they will. if you If you insure sure your car third party only I dont think the insurance company will help you try and get your own car repair costs back if someone hits you, for example. If Fame isn't insured for loss of use, then her insurer has suffered no loss and there's no reason why they would want to get involved in a loss of use fight.

Fame needs to check whether they will, but I wouldn't hold out too many hopes.

Fame, I'm sorry but emotional value isn't usually recognised in civil law. All you can probably claim for is what it would cost to replace your much loved mare with a sound horse of a similar age and ability.

The law regards horses as property. We as owners know it is massively more than that. But that is what the law holds. You need to go through your insurance company if you have one. BHS gold if not. (And - I am really sorry but for the benefit of others reading the thread an without any criticism of you as an owner - this is why you need decent legal cover..)

If the horse is no longer capable of its job then you are owed a replacement value. But it is like for like. So this is the value of a 21 year old horse on open market which - I'm afraid - is not going to be high.
