HELP!!!! Serious Ebay Saddle Problem (another one?!)

I really need some advice.

I purchased a saddle from ebay 3 weeks ago from a seller who had lots of good feedback and seemed helpful and honest. Saddle was a 2nd hand solution freestyle, good condition and concidering they cost 2000 new I thought I got a fab deal at a bit over a 3rd of the original price.

I sent a check and explained that I wanted him to contact me when it arrived and when he deposited it which he did. However, then I didnt hear from him. Cheque has cleared and still heard nothing.
Then got an email saying he was held up as his wife had a riding accident and is in hospital. I wrote back saying how sorry I was but please could he send saddle asap. I've sent 2 more emails since and still had no reply.
Now I understand that if his story is true he would be busy but it doesnt take that long to send a saddle?! I now think he must have been lying all along and I have no idea what to do.
Have looked up his number but he's ex directory.

Im not made of money and ive saved up for ages for this saddle and I need it desperately as i'm rebacking my mare, i've been waiting for 4 weeks already.
 
HI, your best bet is to contact ebay, via 'item not received' dispute. They will ring him direct. You can put a message in a submission box for the dispute which he will get - saying you appreciate his situ blah blah, but 4 weeks is long enough........If he has decent amount of feedback he should care about his reputation. Ebay should help though as you didn't pay via Paypal you are not covered from them
At worst you would have to take him to the small claims court - I am currently doing that over a faulty £300 sink bought on ebay - it's quite a cheap process and clearly you would win any case and fees. Not that it should come to that. But I would get a dispute opened now for piece of mind and to hopefully spur him into action! Hope this is of help.
 
Sorry to hear of your problem. Would suggest that you contact Ebay and open up a dispute. Also try e-mailing the seller again and say that you will take the matter further in the form of county court etc.

Sorry, Im probably not much help but I haven't really experienced anything like this from ebay. Good luck though.
 
Would it be worth sending an email that if you don't hear back, then you'll open a dispute with ebay?

"You can open a case 3 days after the estimated delivery date (if available) or 7 days after making payment (if no estimated delivery date was provided). If you received an item, but it doesn't match the seller's description, you can open a case now. You must open a case within 45 days of making payment on an item."
 
Sorry to hear your problems OP. That is exactly why I always pay via Paypal!

I think you have tried hard enough to contact him and now I would be opening a dispute.

I don't think Ebay can help get your money back unless you paid by Paypal. Best bet would be to ring your bank and tell them that you need to cancel the cheque as you have not received the goods that it was paying for.

You should open a NPS case against him first though, as it may jolt him into action.
 
You can open a dispute with Ebay,but you probebly wont get your money back as your not covered as you didnt use paypal. I wont send cheques or po anymore.
In future I would use paypal for payments,this way your covered.

You can open an Item not Received dispute; however, he can also open a Payment not Received dispute -- as you paid by cheque, this can be quite hard to sort out.
I would email him again, say you are opening a dispute ... hope he's a decent person and send the saddle.
If not, the quickest and easiest way will Small Claims court. Sometimes, just filling in the Small Claims papers and sending them with a note of Final letter before action can get results as it tends to give people a bit of a fright.
