Hiya i have joined Horse and Hound for ages but barely have enough time to talk which i aplogise for!

I need help i sold my horse yesterday my YO as she wanted him and i have difficultly (sp) with finances but ALWAYS paid my livery. She now threatning (sp) to take me to small claims court as i apprantley lied about how he was like even though she had a weeks trial with him plus bought him in everyday- spent time with him etc.

I dont have a reciept as i only gave one to her. (which i am now kicking myself for)

What the hell do i do?!

What is she saying that you lied about exactly?

From you short post it sounds like she has changed her mind for some reason (finances?) and is trying it on, but I'd like to hear more detail really.

I doubt the receipt is an issue - unless you wrote something on it which could be held against you, eg the horse is sound, when in fact he only has 3 legs...

Small claims court will most likely say that she dosnt have enough evidence for this. She knew the horse already and had delt with it perviously and didnt hav a problem. Defo speak to the Cit Advice, they will be helpful.

Go to CAB and I'm sure they'll say its a crock of....


At your age, and you being a 'non professional', and with her being presumably older and more experienced, with prior knowledge of the horse then she is only shooting herself in the foot, along with the previous owner supporting her as then surely she would have had even more knowledge of the horse before buying it? Try not to worry, I suspect this will go away soon, fingers crossed for you.
 
Benson 21 - Yes she does know the horse and knows what he is like (nervous).


Flowerlady - She is saying that i lied about seeing him ridden when i went to view him (before i bought him) which i did. She could as i said i dont have a copy of the receipt.

She said to me before she handed the money over if he isnt suitable for riding then i will just retire him and take the risk.
 
Whether or not you saw him ridden before you bought him is totally irrelevant to her buying him from you (if i've understood you correctly) She is trying it on, go and see CAB tomorrow and try not to worry.
 
I always thought once they were sold it was sold - buyer beware etc. It sounds like she has even less chance of winning this if she has known the horse for a while through you, and knows its previous owner. She just sounds like a bit of a bully. Are you sure you don't owe her any money still - thats not what has caused this? If not, don't worry.
 
Yes you have jrp204 she is trying to use that against me. I thought in my head when she first said that to me it was nothing to do with you - but she is adament it is.
 
Honey08 yes im sure. When she had him on trial i asked will i have to pay livery for that week and she said no- She hasnt even said anything about that
