Help what would you do????????

NEED YOUR HELP!!! My freind has put her loved pony out on loan, we took a visit this weekend to see how she was has they are not replying to her phone calls or text messages!! when we got there the pony was been groomed in the stable by the girl whom has got it on loan, she seems well and happy and settled so no problems there!!! i noticed a padlock on the door which i thought was a bit sus, we was told that they had got her a new saddle so while we was there we asked her for the saddle back which we loaned to her with the pony, then we started to find out things they sold the saddle!! this was a really good saddle cost about £500 its not about the money its about the fact that they sold her saddle which doesn t belong to them, not only that everyone on the yard seems to think and have been told that they own the pony and didn t have a clue that it was a loan pony!!! we also found out that the padlock on the stable door is put on if livery rent is not upto date and if they don t pay up the owner sells the pony has you can imagine we was mortified!!! so we went to see the yard owner she wasn t in but we explained the situation to her boyfriend and we left our tel no and 2 days later we still have not heard from the yard owner!!! I think we should take the waggon and get the pony back!! what would you do? x
 
I would go straight to the yard to get everything sorted out, she should really have seen the livery yard before the pony went there then the YO would know the pony was on loan, selling if livery is not paid is standard in many livery contracts but it is concerning that the stable has a padlock on which suggests that they may not be keeping up to date with the bills.
Selling the saddle may be because they could not pay livery, have they actually bought another one that you saw, if they have I would consider that to now belong with the pony unless the money they got for the original one was given to your friend, it is likely they have done a p ex so there will be no cash or they now have no saddle.
 
Thankyou everyone!!!! i will show her all response from you guys i said the samething!!!! i will get a temp stable put up to help her out and go down and get the pony ASAP its hard to break a little girls heart when its her sister whom we have now found out is the tear away that has sold the stuff and seems to claim everything is hers at least the pony is still there at the min, may drive down this evening to collect the pony for her!!!!!! least that way the pony is safe and cut the losses on the rest of the stuff we can t get!!!!!!!! totally understand the owner having to do what she has to do but at the same time very frustrating that she has not contacted her at all has she would be more than willing to pay any debt owed just to get her pony back!!!!! xxxxx

How long as he been on loan? When was the last time you managed to get a hold of them via phone?
Do you have their home address?

That could be perfectly normal, you said she was a girl, maybe she was embarrased to tell the others it wasnt her, but her mum has told the YO that its a loan?

Speaking to the YO was the best idea, that rubbish they havent got back to you.

Well with this idea at the very worst you get someone screaming at you for breaking the contract, and if she has for talking sake paid for a month, you may have to re-imburse her (unless she has indeed sold the saddle!!)

If it were me, I would like to give the benefit of the doubt, to think that she lost her phone, the rumours about her selling the saddle were lies ( depending on how credible the source who told you was) and that they YO is ran off her feet... HOWEVER.... its your pony, a living being, and given that the pony may dissapear at any time, id go get it now, and wait for explanations later.

It may turn out it was all a sequence of events, however, what will you regret more? Pissing the people off by taking the pony back, or losing your pony?
 
I'd chase the Yard Owner just so that they are completely aware of the situation, you may be able to get some more information about what's going on from them. Agree that they may have sold your saddle to pay livery debts, but it was not theirs to sell! I would get the pony back if you have any doubts.
 
Go and get the pony. Apart from anything else, padlocking the pony in a stable is not safe, what if there was a fire, or the pony got cast? If it turns out to be a mistake you can sort it out later, pony's safety needs to come first. Good luck!
 
Yes totally agree!!! the little girl rang her mum to ask to bring the saddle down has we had turned up, her mum rang her eldest sister whom the loan agreement was with to ask her where it was and she said that she had sold it!!!! It was a lovely lady whom i was talking and just out of conversation i brought up why there was a padlock on the door has there was not one on the last visit?? it was her that explained why padlocks was on the door!! hence why we went across to see the YO we even asked them to let us know if all bills are upto date and explained whom we are and left our details for them to contact us, i feel that we have done all we can, i also gave the lady whom i was talking to my tel no incase she had any conerns and to let me know ASAP, she has contacted me to say that all seems ok this am xxx but still going to get pony!!
 
I would just go and get the pony back immediately.

I'm all for giving people the benefit of the doubt but not when it comes to living things!
I have seen so many horror stories where the owner has concerns but puts up or gives them benefit of the doubt, then months later they are battling over getting horse back.

I do wonder though why owner hasn't been to livery yard before to check she is happy with things and also that YO knows to contact her in the event of problems etc...

Hopefully your friend has a contract which protects her both in terms of her tack and also getting pony back?

Well then its straight from the horses mouth then! (pardon the pun) Pony back... immediately. You dont want any dealings with thieves. And report the stolen saddle.
 
Fetch pony ASAP - any typical loan aggreement has a bit about keeeping the equine safe. A padlock on a stable contravenes this. (Aside from anything else)

Unfortunately, you can.
My car was in the garage (main dealer) for extended diagnostics. My sister who was out saw it parked on a main road in a major city. The sort of area where drunks/students would walk over the top of cars as soon as look at them.
I got my spare keys and took it home. They reported it stolen and although the police were sympathetic to my plight, I was arrested!!
Thankfully, they chose not to prosecute me :)
