A few years ago I was gifted a horse. When I got her I knew that she had been owned by 2 people, but believed she had been abandoned by 1 owner when the 2 owners had a fall out. So, 3.5 years later the owner that gave her to me has said that she has recieved a message from other owner saying she now wants horse back.
The owner who gave her to me is happy for me to keep her but the other one is threatening to come and uplift horse and is also threatening court action against me for keeping something that in her opinion does not belong to me.
I cant really afford to see a solicitor, the horse is only a companion, she cannot be ridden.
I am quite worried about all this and dont know what to do, please can you help?

Are you a BHS gold member? Even if not, you could join to access their free legal team advice line.

Failing that, is the owner who gave her to you a gold member?

Or try Citizens Advice Bureau.

Whose name is the passport in, and do you have any sort of document to say the horse was signed over to you?

It will go into litigation.Who has passport ?Have you anything in writing? Maybe one owner would put in claim against other, then one would put claim in for costs and you could as you were gifted horse and occured expenses could be litigation mess

Not sure where you stand but why don't you get in touch with the person/owner who wants your horse back and talk to them directly. If you listen to what she says and ask her to listen to what you say perhaps she will think about uprooting your horse altogether, especially when it can only be used as a companion.

Stay calm and keep reminding her the horses interests are at the forefront of your mind, that for 3 1/2 years you have loved and cared for her and it would be so heart wrenching for you both, you and horse, to uproot and unsettle her happiness.

Really hope she sees sense and leaves well alone.

I would be inclined to write a bill for the livery for the years that you have been caring for the horse, and give it to the reappeared owner... it may be that you have spent more than the value of the horse, and may make them pause and think...

This is excellent advice. Stay calm and talk to the person who wants the horse back, you will probably find they actually don't want it back, after all, what interest have they shown in it for the last 3 1/2 years? It sounds like you are caught in the middle of a nasty spat between the two previous owners and you need to get across that you are not taking sides, but merely trying to look after the best interests of the horse.

Good luck.

A chat with Citizens Advice would probably help you too.

You might find you have only got half a legal share-as one owner did not give permission for the horse to be sold she technically never gave away her share.
Is the horse useful to you? Is the 'old' owner a good owner to your knowledge? If it's No and yes I would say to her that you are happy for her to buy out your share, as you legally own half the horse (get that in writing from whoever gifted you the horse) and so she cannot just take it, but equally it's not really 100% yours from what I understand
