Horrible situation-what would you do?

Just heard the most horrible thing.

My friend had her beloved young colt at a livery yard. The owner of the yard decided to lunge him with a bit in his mouth without the owner's permission. The colt had never had a bit in his mouth, nor been worked properly and obviously reacted badly. He got his legs caught in the poles of the ring and banged his head so badly that his poll shattered and he died.

What really scares me, besides the fact that a beautiful young horse died so horribly, is that the horse was removed without her permission. I've had someone ride one of mine without my permission and I was furious but, thank god, she came back in one piece.

Where does one stand legally, if your horse is injured whilst being ridden without your permission? What would you do? I think that, if I were my friend, I would probably choose euthanasia by pitchfork for the yard owner.

I'm going to go padlock my paddocks now...

i would be going with the pitchfork idea too or something similarly as painful.
no idea about legalities. i hope this horrible person is made to pay for what she did

I would be seeking advice from a solicitor, to see if there is anything she can do.

I believe that taking something without permission is called theft.

I hope that the police are involved as well as a very good solicitor.

If that is how she deals with her liveries......then I would remove my horses fast.......I would throw the book at her.....don't quite know how South Africian law works!

I would hear from the YO why she did this and if there was no good reason , I would take her to the cleaners legally and shout from the roof tops so that no-one else put a horse with her. How awful.

That is awful. I'm sure that she would have a very strong case agaisnt the YO. If you think that a YO can be responsible for other people riding on their property or a instrutor for the people they are training, they are very responsible for their own actions.

I hope your friend can eventaully come to terms with what has happened. RIP Troy
 
How very very sad and awful.

Does it make a difference legally as to what type of livery the horse was under, ie DIY or full livery? If its full livery, surely the owner has then given a kind of "permission" for the horse to be looked after as the YO sees fit, so then legally it would be a case of trying to prove that it wasn't an accident, but willful lack of care.

Very sad and if I was the friend, I would be handing the case to my insurance company, or as others have said if the horse was on DIY, then maybe contact the police about theft and destruction of property (seems so cold to call a young life that though!

This is just so distressing and totally unnecessary.
Seek the advice of a solicitor, and if you can find somewhere else, get your horses off the premises.
 
Absolutly bl***y disgusting cant beleave it get all the legal advice you can and hopefully all the liveries will be vacating that yard after this make her pay big time............

Me too!! - I would be telling everyone about it and telling others it would be wise for them to move if stabled there.
 
Well if the horse was taken without her permission then it is theft, but I don't know how SA law works.
Poor horse, RIP.
I hope the YO gets what they deserve..
 
This is truly awful and if it was one of mine I think I would be in danger of killing the person who killed my horse! What on earth possessed this YO??????????? Why would anyone lunge or bit a horse that’s never done anything before??????????? Why would anyone touch any horse thats not there's to touch????????????

Please do let us know the outcome of this. Hopefully your friend will be appropriately recompensed. But that doesn't take away the loss does it!

I feel same as silver florin,sick to the bone.The poor owner must be totally heartbroken,this is something she'll never get over.To have your youngster killed in this way by somebody you trusted is beyond comprehension.I hope the laws regarding animal care are a lot tougher there than they are here and that the yard is forcibly closed down and the YO is never allowed to work with animals again.Sadly, as we know,where cruelty to animals is concerned there is no justice.R.I.P poor little Troy.

thats so awful.maybe contact a lawyer and see where they stand legally,ive not got much idea how it would work in the uk never mind south africa.
that makes me sick, i really think i would completely lose it and go insane if i was ever at a yard and YO did that.they would seriously have to watch themselves.
 
having owned a livery yard myself, i can only tell you that my insurance covered me to look after peoples horses for them in the care sense ie mucking out and turning out etc.. i was not however insured to 'work' any clients horse for them and if i offered any instruction to them when they were 'working' their horse and that resulted in an accident then i was liable. I would never have dreamed of taking it upon myself to lunge someones horse unless i was a qualified and insured instructor and had their permission to do so. It should be stated in the contract of full/part/DIY livery what this entails and if that yard's full livery includes the horse being worked then there would surely be an exercise plan drawn up? all sounds very bad news to me and strongly suspect this person should not be owning a yard!
 
That's just shocking!
I only had one incident when YO used my stallion to cover his mare without my permission and without even me knowing (someone else told me a few months later!) but it's no near as bad as this!!

I would definitely try to sue the YO.
 
Good point by Doublethyme; what type of livery was the horse on? On my yard, all horses are on full care livery which gives me carte blanche with how I handle these horses. I don't do any work with these horses who board at my farm unless I am paid separately for it, and obviously I have enough sense not to work with them in a manner which they are not equipped to handle. However, I am insured to, if for some bizarre reason I decided to.

That is so tragic. it's not clear if the YO had permission or not to work the colt, but I would expect someone in such a position to know what they are doing.
