Horse Back to Dealer- still no refund

I've read loads on here about different situations and how things have worked or not worked out for them. Really looking for advice on what to do in my situation.

After some really dangerous issues with a horse, had to send back to the dealer, kept him aware done loads of research on the horse myself too. Finding out some of this has been a 'trait' for a long time. Not easily fixed. Issues were mainly in the field, treating humans like horses, backing up to kick, also charging teeth out meaning business until your out her space. Not just me but other people too, who were no where near her or any interest in her. Again after research, this is not the first time. Dealing with this horse out the field (she only came up to gate if a certain other one did too, trying bring her in otherwise, your taking a major risk) Riding wide a total gem to hack. School not so much, like a good buck, spin and also a rear too. Backed up by another previous owner. She is a sweetie but very much jekyll and Hyde, can't have that on a livery yard where I am.

My question is, sent the horse back nearly 2 weeks ago. I don't have a refund, the horse is advertised for sale now. What the hell do I do. Not a chance of money back it's all sent to other people or cash (I've done a bit of searching on that front too) is my best option to take exchange and make it work? X
 
Are you a member of the BHS? You can get advice from their legal team if you have Gold membership as I took advantage of this when I had issues.

Make sure you screenshot and save any messages between you and the dealer including transactions. I kept all my What's App messages. Ironically my sellers name was saved in my phone as 'dream horse' which wasn't so much a dream as a total nightmare at the time.

It is alarming that the horse is up for sale again. Ready to rip off and hurt someone else.

Did you get any vet or physio intervention with the horse that might strengthen your case? Would previous owner provide information in writing if needed?

I personally wouldn't want to deal any further in respect of exchange with this dealer. They have shown their true colours. I'd not trust them as far as i could throw them. Seek legal advice ASAP.

Check out this thread, is this the same dealer mentioned there?https://forums.horseandhound.co.uk/threads/looking-for-dealer-recommendations.845639/. If so there are several others who have had this issue, most eventually got their refund, but after weeks of chasing.
 
I also thought it might be that dealer, having recently read that thread.

Peaches, I wouldn't accept a replacement from whatever dealer you have been dealing with, as they're likely to give you another unsuitable one. Just insist on the money being returned and keep all written correspondence such as texts from them and you regarding the situation.
 
Most solicitors will give you a bit of free advice over the phone for about 20 minutes. Try someone like Jackie Fulton. Put in your recorded delivery letter to dealer that you will be going down Small Claims track if you dont not receive the money by such and such a date.

Yes great idea. They need to be aware you're not messing around.
 
This situation could be complicated if the dealer is actually an agent, ie allegedly selling on behalf of a third party( as I found out to my cost £££). Hopefully this isn’t the case for you though.🤞Good luck- and I hope you don’t have to wait too much longer.

No. You have a contract with Lynn that she will refund you in 7 days. That rarely happens and you will go through a lot of stress before your money is returned, usually in instalments. All the horses on her website have almost identical descriptions. Safe enough to put your toddler and granny on. Stick to your guns. You will get a refund eventually.
 
I’ve been on there now and seen lots of negative ones, I think it depends how you search?
Equine dealers.com only has 5 star reviews on as she gets any less removed. I know this for a fact. I have known customers that have tried to leave a negative review and it gets removed very quickly. Emails to the admins of this group do not get a reply if your review is less than 5 star. Presently reviews for equine dealers.com are not being accepted.

Oh ok I was talking about the dodgy dealer pages on facebook 😀
 
With in the last 3 months I have gone through the lynn refund system
You will get your money don't worry but it takes time and daily messages
You will get told a load of bull s,,, and and sent screen shots showing payments due to you which she then cancels
Send a message daily, say you won't full payment by 3pm etc
Quote her contract
She will also pay you £250 extra as hush money
Took me 6 weeks to get full amount back to give you some time scale

You could be talking about the experience I had with her. Word for word. 🙄
 
A friend of mine went down the trial route with LR, the horse didn't arrive (due to last minute issues with the vet report). In the meantime, LR had her money for three weeks whilst this was going on. She did get her money back after lots of stress and chasing, the money came back in installments. My friend wondered if the horse was ever available and if this was a way of getting free funding. Friend also posted the facts on a well know Facebook site for dodgy dealers, said post was taken down despite it being factual and a request for feedback from others to see if they had been in the same position.
Said horse was still being shown for sale at its full price. Would strongly advise not to go the purchase and return route.

Paid in full to be told horse had sarcoids which had only showed up up on a vet inspection
Second horse did not travel only came to light when it was being returned from a trail
3rd I was talked into a 4 Yr old I did not want so young so asked for full refund then the fun and games really began
I feel she just gets the money in to fuel her lifestyle pay others back etc, it's just an ongoing saga

the horse I had on trial had 7 sarcoids which were undisclosed during all my conversations with Lynn. Indeed she said the horse didn’t have them when she left her yard so must have come up in 24 hours. Horse was an Appaloosa cross mare. As per usual of Lynns return policy it became a very distressing difficult time but did get refunded in instalments.
 
A little further detail, a delivery date was arranged the following week. Was then told the horse needed the farrier so could the date be delayed a further week. Day before horse due to be delivered, friend was advised that the vet report had arrived with a history of suspensory issues. Friend rejected horse, then took a number of weeks to get money back. Was told that there was a limit on how much could be returned as daily limit had been hit. This is what triggered friend's questioning of the system, if the daily limit was being hit on a daily basis, how many refunds were being given?!
 
I have created an account to also hop in and share that I had very similar experiences, very similar excuses and very similar stress in trying to get my money back from LR.
She is incredibly slippery to deal with and there is a vaguely plausible excuse for everything so I gave her the benefit of the doubt for far too long. I looked at all the 5 star reviews and trusted her. I did research beforehand (clearly not enough) but didn't see any of these Horse and Hound posts or anything in Dodgy Dealers. I can't even post this on the linked post above as it has had its replies closed - so apologies Peaches24 for derailing your post somewhat.

After several failed buying experiences, the two week trial sounded like a good idea. In hindsight, the poor horse was probably being bounced from yard to yard and had not been at their yard for the length of time Lynn stated. Issues that cropped up were...
Horse could not travel before a certain date as he was due the farrier.
Horse could not travel as their transport had broken down.
Important (and it ended up being deal-breaking) information was disclosed just before horse was due to arrive - after I had paid for strangles test, paid my deposit and paid for transport to my yard so I felt obliged to continue and hope for the best.
Horse arrived with undeclared lumps and bumps
The saddle which came with the horse did not fit
Horse was sent back and Lynn confirmed she was all ok and everything was well. Then the excuses about why my money hadn't been sent back started which included reaching a daily spend limit and scheduled payments not going through. Her contract means nothing, she paid me well outside the 2 weeks she writes into her own contract. You have to be really persistent to get your money back and not rise to the lengthy messages she sends with excuses, accusations and guilt trips.

Oh yes good old farrier
I know a unshod horse needs farrier but even a unshod was due farrier
Was not allowed to have horse delivered and use own farrier, even though horse was paid for in full so in theory my horse
 
I was on a yard where a lady had a horse on trial from LR. It arrived with the most awful sand crack on one foot. One look from the farrier and he told her to return the horse or get the vet out to xray etc.

She did go on to successfully purchase from LR shortly after.

Another person I know had a horse on trial which was deemed not suitable after a vetting.

It took approximately 6 weeks for the refund to be arrive, despite being assured weekly it was on the way.

A close friend enquired about viewing horses for her daughter, highlighted the ones she was interested in etc but was told she could either go and view one, or take on on trial with no viewing.

I think LR does business this way as the majority opt to have on trial, she has the full purchase price in her pocket and this bankrolls refunds due for returned horses and pays for new horses.

A previous employee shed some light on where she purchases the majority of her horses from and the profit she makes, so I think she does well from the way her business model works. By all accounts, if the ex-employees tales are to be believed, a horse arrives one week and is up for sale the next, with very little happening in-between.
