If a horse was bought of a dealer but sold on behalf of a owner would the buyer have any comeback if the horse proved unsuitable? Just wondered if anyone knew. thanks
Nope, it is a common misconception that if you buy from a dealer you always have come back on them - it is very important to check that they are not acting as an agent, as in the case above. It reverts back to being the same as if you are buying from a private vendor, so *buyer beware*.
if the dealer is acting as an agent then yes you have comebackn on both vendor and agent! but do your best try it a couple of times and think! do NOT over horse yourself and get it vetted. Its not like buying at marks and spencer with a 31 day dont like it exchange. remember a horse is a living being with its own mind and might play up cos it doesnt like you, or you have changed its routine and its tack and its feed and its routine and its friends etc! and maye you have oversold yourself in your abilities and confidence? ............................................................ i could go on.
Unless the dealer has stated that they are *selling on behalf of client/owner/etc* then, last time I checked, no, you HAVE to go after the owner, not the dealer.
Yes, go after the dealer - the dealer was the one you made the contract with. Is this a hypothetical, or has something happened? If you let us have more details, happy to provide a few more thoughts!
