Horse kicked car in field, are we liable

no, I would say not. Farmer may have said yes but then it's his problem, should have stated at her own risk. Stupid idea, one and only time I have done this, my horse put teeth marks all over my bonnet lol, wasnt fussed but....

No solid proof it was your horse....witness doesnt sound independent and I think any normal insurer would also tell her where to go! - do speak with your insurers before giving out any details.

Our horse lives out in a field with a bunch of other horses, and last night we got a call saying that our horse had kicked out at a sharer's car that she had taken into the field.
She has a witness and they say he just kicked out while playing with the other horses causing some damage, and now she's demanding our insurance details.

Would we be liable for such damage given he was in his field and they took their car into it?

Any advice would be greatly appreciated, first time being confronted with this scenario.

I wouldn't pay, it is a risk you take, when taking a car in the field, I can understand if the usual vehicle is out of action, as I nearly had to do that when tractor died, but it is a risk you take we poo pick with small kubota and trailer, and weelbarrows they do come up and sniff in it sometimes, but a car, why in gods name did they not chase the horses away when they got too close. We have to with our Kubota when they come sniffing around. They need to be more vigilant if they do this, they were not, and did not do anything to stop horses getting to close or were not watching so their problem.

Maybe they did chase the horses away and one horse kicked out. Problem was the car copped it. So they concocted some story about the horse kicking the car without being provoked.

I once parked my mare night next to my car (I was a teenager) then thought, what the hell am I doing?? Shooed her away and she booted the car's flank with her hind leg. Put a little dent in it. It was my silly fault.
 
If your horse gets out of its' field and kicks a car on the road or in a parking area, then you would be liable. If a car goes into a field with horses in it, and hurt the horse in any way, the car driver would be liable. If anyone has any liability, it is the property owner who gave permission for driver to go into field - and of course, if a horse had panicked and crashed nto the car (or defended himself against a noisy 'predator', or just kicked up his heels - and was injured, you would have a claim against the car driver AND the livery owner. I really don't think you have any liability - but obviously I'm not a lawyer- and the law CAN be an Ass - as can insurance companies. If you're a BHS member, definitely legal help line. But you should contact your insurers for advice - and because if you DON'T tell them about an 'accident', then they can tell you you're on your own. I have to phone my insurers this morning over a nasty accident involving a member of my staff. Different situation, of course - Employer's liability. I don't think there is ANY chance she will sue me - and my insurance won't help with keeping her on full wages for months, but you DO have to cover your back.
