Horse kicked out hunting!!

Last week horse got kicked square in the shoulder out hunting - not my fault and it was the irresponsibility of the other rider that caused it. looked horrific as his leg just hung there but ended up he just had a 'dead leg' phew! although vet said give him a week see how he is as it can be badly bruised, still lame as it turns out, so does anyone no if I am able to claim on the other persons insurance for vet fees as vet either wants to take the route of complete rest for X amount of time then see how he is or go straight for xrays etc which is going to cost? Any advice will be helpful. Thanks
 
do you know the other person? seems like an unfortunate accident to me, was the horse wearing a red ribbon on the tail?

also what conditions where you in when you got kicked? ie. jumping/galloping or standing?

i doubt you could claim on the other insurance, but what about your own insurance?
 
I know who the other person is, we were stood on a track and her horse wouldnt stand still, where everyone else was, but instead of moving to the back or taking it for a walk she kept spinning it around which eventually exploded to bomb off and kicked my horse, I wasnt even stood near her but she lost control, I was just in the wrong place etc.. She admitted it was her fault. My horse is 16 and took the decision last year not to renew his insurance due to his age and the fact we had never used his insurance in his first 15 years! Sods law this would happen now. I just have insurance for myself and public liability?
 
I'm sure you could claim off her insurance, as it is public liability. I.e if you had been in your car and this horse had jumped on the bonnet you would expect to claim off their insurance, same goes for your horse. However if she refuses to put it through her insurance then if you are not insured I don't know what happens since you would normally instruct your insurance company to pursue it.

still dont think that you could claim off her insurance, but you could ask her to pay towards/all of the vet bills that you will incounter? as she has admitted her fault and all...

but she could just say that it was an accident and these do happen, but i really dont know how she will react. otherwise you dont lose anything by asking her, and she may agree to help! *sorry im rambling again - bad habit*

not all that clued up about public liablility though!

As you have no insurance (I don't blame you either for an older horse) I would be having a nice word with the guilty party, preferably in public (like at the next meet?!) to ask should you forward any vet expenses to her or straight to her company for the injury caused to your horse! If she says on your bike then at least you know where you stand but you did have witnesses that heard her admit her liability on your side last week. This also means to be totally fair you could be well within your rights to say loudly and clearly 'do you remember my horse being kicked last week? Well, who did it refuses to pay or help with any of my veterinary costs, that's not very nice of them is it?'!

TBH, I would also be very miffed that they haven't even had the courtesy of ringing to find out how the horse they kicked is; that's not at all polite.

Good luck, I hope you get some joy; after all, who would want a reputation as a miserly Scrooge who doesn't play fair?!
 
As far as I'm aware you may be able to claim off her PL insurance (providing she has cover?). If she does not have cover for her horse and you don't for yours then you may struggle. However, if the person has house insurance then the PL should be covered under that.

To be honest I think it'd be worth a try, you have nothing to lose I guess and especially if you have other witnesses who saw what happened?
 
I hate this society of blame. If you take your horse out with other horses, you should be insured...what if it had been your horse kick out and injure someone, surely you'd be devastated if they tried to claim against you?

IMO, instead of claiming, learn your lesson and insure your horse.
 
judziah-so we should all pay for a horse getting kicked by someone elses when it isn't our fault?
IT's not the soceity of blame for people to take responsibility for their horses actions.
 
Just my opinion but being around horses is high risk...if you don't want your horse run the risk of getting hurt then don't take it hunting. If you are going to run the risk, be insured!! Horses are unpredictable, no matter how well they are trained...so how can the other horses owner be to blame? She didn't injure the horse!
Why not move your horse away if another horse misbehaving?
 
Sorry but I disagree with you - she said she was standing nowhere near the horse and the horse exploded and ended up kicking her horse. Think about it as cars - you have your car parked on the side of the road, someone reverses into it and causes damage - are you going to say "Don't worry mate, my fault for owning a car and parking it on the road"???? No, of course you are not, so why are horses any different? If your horse kicked another you have admitted you wouldn't foot the bill to repair the injured horse - shame on you IMHO, it is not about blame culture, it is about facing up to your own actions.
 
When my horse was kicked by another at a sow- we were standing in a line up, and the other one ran backards and sidewards to get us- my insruance company said that it was an accident- horses do kick- and unless ther other pony was known to be likely to do this, they would not be persuing the owner- as they would have to prove that she knew he was a risk and was negligent in him do it.

In this case, she should have removed her horse from the crowd, but oh for the benefit of hindsight -
so if you contact her, just ask for detials of her insurance, and see what she says.
 
Yes, accidents happen - I would not be mad however I would expect them to pay for vet expenses. I would happily pay reasonable expenses if I was at fault.
 
ooo nasty... i only thing i can suggest is you ask (at next meet) rider of said horse to see if they will pay, but be prepared for them to say NO

and if they are insurance IMO they will say No aswell
But IMO if you going out hunting... horses will kick, stumbe, blash into each etc....

IMO it's is an accident and these things happen, unless that horse had red ribbon i don't see you have any or should way of claiming off there insurance (if they have any???)
Why can you claim off you own??? if you don't have any - i'm sorry, that's life....

A proper decent normal person would have offered (part payment) or at least checked up on your horse.

My horses have been kicked in hunting field and both times rider of offending horse were very good BUT didn't pay vets bill NOR would i expect them too. I'm sorry horses can and are unpredicable and IMO this sort of insurance claiming pushes up policies costing etc...

If we follow this through does that mean if my horses loses shoe through someone standing on it (they have got to pay my shoeing bill), or sue farmer for having heavy ground............. where do you stop........

But in saying this i still wish your horse a speedy recovery
