Horse Passport advice

Before I start I know it is an offence to buy or sell a horse without a passport but I'm really stumped...

I currently loan a horse who I am thinking of buying. She does not have a passport as her owner was always told he was going to be sent said passport but never was, he then said he was going to get a passport but hasn't. If I were to buy her where would I stand on this? I am more inclined to think that he needs to get the passport before I buy her but I am really not sure. Any advice?

Is the horse chipped? if so get if scanned and order a duplicate passport,
 
Just get vet out to passport and make him pay for it, horse will need microchipping too if not already done, the vet will check for that if you ask. I would be cautious if you didn't/don't know the horse's history though, I am assuming that the owner has had the horse since pre passport days, if not then definitely have scanned for a chip.
