Horse share and risk to sharer

Is there any legal document that an owner can get a sharer to sign to say that they are not responsible for any injury or damage caused by their horse? Also, if one of my liveries shares their horse, can I as a livery yard owner be held responsible for any injury caused by the horse to the sharer? And if so, what do I need to do to cover myself? I already have public liability insurance for the yard, horses and dogs. Thanks.
 
You mean that your liveries are looking for sharers?

I don't know all the ins and outs of what you would need to cover yourself but my old yard use to ensure anyone riding on the yard had to fill out documents stating their details, medical issues, level of ability etc and to sign to say they understood the risks involved. It was partly to help should an accident ever occur, but to also help cover the yard owner with the fact people had acknowledge risks and were willing to still ride. Perhaps you could put something together like that?

ETA- livery agreements also stated that any guests were responsibility of liveries and they would be responsible for their safety whilst on the yard. Could something like this be adapted for sharers too?

Thanks. Yes one of my owners has taken on a sharer and asked if I had a contract I could adapt for her. I don't unfortunately, but then wondered if I would need to cover myself too as the horse is on my premises.
 
As a livery yard owner you do have a legal duty of care for horses & persons that are on your premises whether they are clients of yours or not.

I would make a yard rule that insists all liveries had their horses & property fully insured & that any sharers/loaners are to take out their own personal injury insurance to cover themselves. This would cover you in some ways, but I would double check with your insurance provider that you are covered in case you are deemed negligible.

Insist on the sharer having their own riders insurance and you seeing a copy. The owners insurance does not automatically cover another rider for any injury ( this is certainly the case with NFU). So, as an example, sharer goes out has an accident. Owners insurance would cover any damage the horse does but NOT damage to the rider. You could check about having a waiver saying horses ridden are at own risk but quite frankly, I would insist on your liveries making sure their sharers have insurance. Otherwise said sharers might well default to coming after you.
