Horsebox company not honouring service plan

Hi,

I had a 7.5 conversion done last year and included in the package was a two year service plan. The owners of the company have now shut the company down. I didn’t know until I applied to get the first service done plus some other bits that I assume were covered by the warranty. Apparently the service plan is now void . Someone else has bought the design rights apparently but there is no provision to honour the service plan. Gutted as I really scrimped to get this lorry as I wanted peace of mind with something that wouldn’t break down and decent customer service. I hadn’t bargained for this unexpected expense and indeed the service plan was one of many reasons I went with this company. Is this something I just have to accept? Just feeling a little let down at the moment.. also don’t have any decent reliable mechanics near me so another stress…

How did you pay for the plan? If by card, you can claim through the card company.
If not, then you can go to the small claims court if the director won’t honour the agreement, or refund you.

Now that’s a good thought about claiming if you paid by card.

Even if you go via small claims court, getting your money from a company that has ceased trading is likely to be like getting blood out of stone. Only you can weigh up the amount involved and whether it is worth a try.
 
I’m wondering if there was a plan to shut down? Certainly the package was a sales incentive. Proving this is the problem. Paid by bank transfer in three stages.
 
Morally that doesn't sit right with me, regardless of whether it is legal.
Yes it’s a shame as when this company was running it was highly respected. Who knows maybe there were financial difficulties? I’ve really scrimped myself to buy this though so it’s put an unexpected financial burden on me just as the insurance also need renewing 😖
 
If the company is still in existence then a small claim against the company for the cost of a service could be threatened or actioned as the contract is with the company… find out how much a service would be at another firm and write to the company’s registered address informing of your plan to sue and sue where that gets you

You need to find yourself a good local mechanic.

Wonder if the facts were checked before posting?? Life can change over a few months. Appreciate you MAY have contacted the people concerned but there are always at least two sides to every story.

The facts were correct from my side when I posted.. not old or fabricated news. I was hoping you might have known something I didn’t or was I reading incorrectly into your post? I’ve checked the information again and apart from the fact the company has officially been passed over now the facts regarding the service package remains the same. The new owner claims to be looking after the former customers but this particular aspect is definitely not supported. What one reads on Fb and the reality seem to be two different things.
Please elaborate on what the other side of the story is as your post seems to be driving at something that I know nothing about.

It depends on how they’ve wound up the business as to who, if anyone, is liable.
I don’t really want to publicise the company on here. I have a superb horsebox and despite my huge disappointment I personally don’t want to tarnish this persons reputation. The new person has not bought the whole company.. just the designs . He’s not taking liability for the warranties. I guess the company was wound up in a way so nobody was liable… but it seems that the previous owner should have done the decent thing to honour it as this after sales package was advertised to be included in the purchase of one of these boxes. I guess they think anyone who has this box can’t afford to foot the unexpected expense! Very sad affair.

The the blow is worse when one has put 110% trust in a company. Ive really stretched myself financially to get this vehicle so the service plan that came with it was certainly a significant part of my purchase decision. If it was a dodgy company I could have accepted it easier. I’ve been taken for a ride so many other times with previous HB manufacturers ( including two other ‘respected’ names). I always say it’s not what happens when you are buying… you can judge a company by what happens when you have already paid and then things go wrong. I’m not sure that there are any HB manufacturers with solid integrity now?

What were you told when you asked for the first service? Was this very recently following the announcement on social media, or before? Seems to be a fair number of us all in the same situation.
 
Find a good honest mechanic (there are a lot if us still about. Someone who will take pride in keeping your truck safe and sound. Forget the past ,find your mechanic!

Where are you based.. think I have found someone but always good to have someone in reserve just in case. Good and honest rare in my vicinity .. hence I bit the bullet and went with the company that has unfortunately now closed.
