How long should I give her... (loan pony saga continued)

Right, so I have my pony back (who has gone to new loan home immediately and has settled in brilliantly!) but when we picked her up, half of her tack and her passport was "on the way" with a friend of the loanee. The friend never turned up, so we left with just pony, and the promise that I could pick the rest of the stuff up the following week.

Well, we are now over a week on and the woman is not answering any of my calls/texts or returning my messages. I don't want to threaten her with legal action as I was hoping this could be amicable, but I am now thinking that will be the only way.

Should I leave it any longer before leaving a message saying "I am going to contact the police/go through small claims if I do not hear from you soon" or should I just get on and do it this afternoon?

I am fuming as this woman is always going on about how her dauhter rides ponies for all these well known people (does a lot of pony racing and does ride for some reputable names) and I wonder if she treats them how she did me. Should I contact them and warn them??

At least the pony is ok - she has not shown any of the behaviour that the previous loanee described - she even trotted up the ramp of the trailer when we went and picked her up (apparently she couldn't get her near one or lead her in from the field with out rearing). We had a new saddle fitted for the pony, and she was as good as gold.
 
Just do it - she's had long enough.

Having read your previous posts (pleased you've got her back BTW) I'd be tempted to not give her any option now. Phone her now tell her if you don't hear from her within a hour to arrange collection of tack and passport she has left you no option but to procced with legal action.
 
Apparently she was away the weekend we picked pony up, so she gave her friend the stuff to give to us when we arrived at yard. No one was there when we arrived, and we waited and waited and in the end called her and she then told us her friend couldn't get there so she would bring the things to us. We haven't heard from her/been able to contact her since.

Gods, she sounds awful! What a load of cr*p she's told you and what a horrible b*tch. I would contact her one last time, phone if that's your only option (which does seem to be the case) and tell her that if the stuff is not returned by tomorrow or she does not give you an address to pick it up, you will be reporting the theft of your tack and passport to the police.
 
I agree with the other posters here. Get tough with her. She is just messing you around and IMO its no better than theft. Tell her she has x hours or you are taking action. But make sure you follow up through

Good luck with getting your stuff either by just turning up/SCC/whatever. Would be cautious about 'warning' others the daughter rides for though - don't think it would make you look good/help with SCC/etc.

Oh, easy peasy then. Get solicitor to write to her - recorded delivery. That should put the frighteners on her.
 
Send a Special Delivery letter outlining all that is required, to be returned to you within 7 days of receipt of letter or legal proceedings will commence.

Don't txt or phone anymore..it could be misconstrued as harrassment.

Do everything above board and duplicated on paper....
 
I had trouble with my first loaners for my pony not returning things (mostly rugs and tack). My solicitor friend told me to email them initially - do you have an email address? He told me to tell them that they had 7 days in which to return all of the outstanding items (list the items) and that if they weren't returned by the end of that time (give them a date), you would be referring the matter to the Small Claims Court. I think I said something like I had already taken legal advise.

But TBH if I was you I would just go and get my stuff, 3 hour round trip or not.
