HOW TO CLAIM MONEY BACK FROM A STABLE COMPANY LET NEVER DELIVERED!!!!!

Coming up 2 year in August i ordered more stable at my old property to match with the ones i all ready had from the same company. The company Wiltshire Timber Products wanted a deposits which was paid at £2750.
Had such a great service 2 times before didn't seem a problem.
For some reason or another they didn't make it to us and nor did our deposit. You try and ring and you get nothing. The company is NOT limited and he hasn't gone bankrupt. I keep letting it slip my mind however it is a few hundred ££££'s it's a few Thounsand££££'s.

What shall i do how do i go about it??? Don't really want to spend out even more money and not to get anywhere.
 
I think you need to get a lawyer involved and get them to send them a letter pronto. If no response then you will need to start court proceedings. HOWEVER, I'm not sure if theres a time limit on these things since you've left it for so long.
 
Write a letter detailing the amount paid and asking for a refund and written response within 28 days and warn that you will file suit in the small claims court if you do not receive a response within that time frame. Send the letter by recorded delivery. If no response within 28 days, file suit in the small claims court. You can do it online. They then have 28 days to file a defence or the court will award in your favour. You must however stick to the time frame - it looks good in court. You don't need a lawyer and you can present your own case in court if need be. Most companies will back down when they receive the summons. It might be worth paying for a one off appointment with a solicitor to go over your case first though. If you win your case, the court fee will be awarded to you - the company will have to pay. If you win and the company still doesn't pay, you can then file with the bailiffs to have them reclaim your money for you. That's a long way down the line though!

I would also contact the Citizens Advice Bureau and Trading Standards.

One other thing, there is a 5 year time limit on the small claims proceedings - so you are fine for time but I'd get on with it. Courts look more favourably on organised efficient people!
 
Oh forget to mention i have written to them on MANY occassions. Then he sent me a letter from a Lawyer saying he had land for sale and once sold he would pay. It's banging your head against a wall.

With the small claims court they can't actually make him pay can they if he says he's got nothing. To lodge it it self is about £200. The lady at the court at the time said it would be easier to sort it out, out of court, there are records of commication between myself and the court. I found out they even had an unpaid bill with H & H at the time.

Have you ever tried talking to Citizens Advice or Trading Standards i was appalled by the service all passing the buck!!!! All to lazy!!!

Someone did say i can turn up at his house and sieze goods??
 
Mmm. No I don't think you can do that. You need an official judgement from the small claims court (personally, I'd bite the bullet and pay the court fee and expect to win and get it back) and then you can apply to the bailiffs to seize his goods for you. Otherwise, I think that's breaking the law. If he claims to have 'nothing', he must file for bankruptcy or the judgement is binding and you have the right to enforce it, via the bailiffs. They will seize property and goods to the value of the amount owed and auction it for you. To be honest, if it goes that far, I'd expect the guy to back down sharpish! Might be worth having a word with your local constabulary as well, they can be helpful.
 
If you have a letter from him stating that there is a debt that he agrees to pay(with the amount), you shouldn't have to go to Small Claims.

The bottom line is that he personally owes you money and if he has to remortgage his house to get it to you, so be it. Don't let him off the hook!

I know its a little way away from you, however have you considered a visit to them? At least then you can check if they are still trading and whether they look like they are worth pursuing, plus if you get to speak to him calmly you might put enough pressure on him to pay you back?
 
MONEY CLAIM ONLINE.... dead easy, 50 .00pounds for a claim against a business, which you claim back from the stable company in your claim form.....ive done it several times, usually they settle when they recieve the forms.
First you have to write to them , send recorded, and state that if the money is not refunded to you with 14 days or by ...date then you will take them to the small claims court , and google MCO and fill forms and ya done.
