I am so upset - Renegging on Loan Agreement.

Hi. Not been on here for ages so I am sorry its just to moan but I need to vent and need advice. I loaned my horse out last month, I wasnt overly keen to move him from his yard but let myself get talked into it. The loan agreement had a 30 days notice period of termination drawn into it (it was 60 days but I have since found out my ex who represents me in the UK changed this to 30). I got a call yesterday from ex saying the loanee wants to return our boy cos he is "too strong". I emailed the lady concerned about the notice period being applicable but as usual, no reply from her and then I just got a message from my ex saying he is being returned TODAY. I realise that if they have already given up on him that leaving him there would not be wise, thanks ISH too for making me realise that. I am livid though, the notice period was drawn into this for THEIR protection as they were worried I would come home and demand him back. They have only had him a few weeks, less than a month, and he has not been allowed to settle in. Can I insist they pay for the next months livery as they are renegging on the contract - can I do something legal about this being as the agreement was witnessed etc? He has not put a foot wrong for us, and when my ex worked away, our friend cared for him and he was perfectly behaved. How can someone give up on him so soon just cos he is a bit bargey and strong on the lunge - surely this is just him "trying the new girl out?". I am so upset, another move for my boy that I did not want. I am never moving him from our yard again for anyone. I am not slating the loan person on here, just so so disappointed as I only want what is best for my boy.
 
(Hugs) it's always horrible having thought you've made the best decision for your horse only to find out that it isn't at all, it must be especially hard for you as you're not able to be physically there to fix the situation.
From my experience all too many people that have a horse or pony on loan are unwilling to deal with any type of problem what so ever and return the loan horse for the minor ridden or behavioural problems even if the horse is testing them out or they have caused the problem themselves and are unwilling to investigate any medical issues that occur.
I've had my rescue mare for ten years now and during the first two years she had some very serious ridden, behavioural and health problems that I spent the time, effort and money working through and I know there are many more people out there like me. It's a shame that the few people who take a horse on loan without taking full responsibility for 'it' give all of us a bad name.
 
Take it on the chin, suggest they may like to help with the livery cost as they haven't given you notice, but thank your lucky stars they haven't started wacking in stronger bits or spoilt him. If they didn't return him you could have ended up coming home to a totally different horse.
 
Tell them that they have to pay for full livery for a month from termination of contract and sue them them in the the small claims court if they don't.
 
I'm just so sorry to hear that things haven't worked out as you had hoped. I know just how important this was to you and the lengths you went to to try to do the right thing for your lovely boy.

It's definitely the right thing that he's coming home. Heaven knows what they may or may not do to him had they kept him for the notice period... Last thing you need I know with you being so far away, but better in the long run.

Hope there is a solution soon, take care and try not to worry too much. He's back home now, you know he'll be fine xx
 
I think from a legal point of view they are in breach of the agreed loan contract. From your point of view I can understand that you are upset and want the best for your boy. However, I would be more relieved that they've had some sense in returning him safe and sound rather than trying some other means like stronger bits, gadgets etc. Can your ex look after him or find alternative loanee?
 
It seems to be very common at the moment. My lovely boy has just returned from a failed loan in a terrible state. She said he was rearing......my boy never reared in his life, then she admitted to pulling one of his teeth out!!!! she changed him from a hackamore into a pelham completely going against our agreement. He is head shy, scared of raised voices, goes on the floor when you try to rug him, heaven knows what she did in 3 months but he is not the same horse.
He still has the same set of shoes on and is under weight.
Im just glad he is home.
But now I have to sell my new mare to be able to keep him, I cant put him through that again.
I do feel for you but just get your horse home.
As for contracts my loanee claimed not to have one!!!!

Thank you everyone. He is now safely home and I will keep you posted. I may be flying "home" sooner than I planned - for a brief visit but lets hope it doesnt come to that. Alternatively, does anyone know of or have experience of costs and time involved in shipping / flying their horse from UK to Oz? Yes I am serious, deadly serious.
 
Hi there everyone. Update. He is settled, happy and behaving like a blooming angel with the new lady who is totally besotted with him. At our yard only 2mins from our horse. He is being ridden out everyday, spoilt rotten and going to a jumping clinic this week. I am so so pleased for him (although I am receiving no money, his happiness is most important) but on Saturday I cried buckets, just brought it home all the things I could and should be doing with him. Bad mum. I am riding again later today and am settled into a new riding place that I have got friendly with the pom girls there and can go out on my own for hours on end, but its still not my own baby at the end of the day....mind you I am riding in 38degree heat which is rather nice (in hotpants topping up the tan). Fingers crossed my boy stays happy, Ill keep you posted and also if and when I decide to break the bank and ship him out. Thanks again everyone.
 
You must be very relieved. Fingers crossed it all works out for him this time. Riding in hot pants sounds good (though it wouldn't be a pretty sight if I did it), waders are more the order of the day round here

He looks a lovely horse. Just my type. If you are thinking of Oz please take in to account the different climatic conditions. My suspicions are that he may not be very happy in all that heat.
 
yes owlie185 the climatic conditions are exactly the reason i left him behind in the first place and believe me lots of research is going into the best place / coolest / less fles place would be for him if i did bring him out. i fear hogging and feather trimming would be order of the day regardless though and that thought kills me!
 
Really happy that you seem to have found a solution. He's way too special to be messed around by those other people.
