"Tony Wright, the first huntsman prosecuted under the Hunting Act, has had his conviction overturned on appeal in Exeter Crown Court today.

Mr. Wright, of the Exmoor Foxhounds, was found guilty in August last year at Barnstaple Magistrates Court, despite having used two hounds to flush foxes to be shot on 29th February 2005 as he believed was allowed by the Act. The Exmoor is one of only two fox hunts that have been prosecuted successfully. More people have been convicted of hunting rats under the Act than have been found guilty of illegal fox hunting.

Judge Cottle concluded by saying: "During this appeal we have enjoyed an extended opportunity to observe and to hear from the appellant. And we have no doubt that he and the Master of the Hunt genuinely wished to comply with the Act. On that day, with the benefit of hindsight, the arrangements in place may not have been sufficient to ensure compliance with the Act but we are satisfied that the appellant has proved that he reasonably believed, perhaps optimistically, that he had put in place the safeguard that would ensure compliance with the Act."

Simon Hart, Chief Executive of the Countryside Alliance, said: “This verdict is an absolute vindication of Tony Wright and the Exmoor Foxhounds and another nail in the coffin of the Hunting Act.........

“While we celebrate this judgment, however, we must not forget why an innocent man faced with a vindictive private prosecution has had to spend over two years and two court cases to clear his name.

“The Hunting Act is not only a pointless and prejudiced piece of legislation, it is also a very bad law. If the courts cannot be sure what is hunting and what is not how on earth can anyone else?

“Only by scrapping the Act can we ensure that other innocent people will not be persecuted and today’s result adds to the clear case for its repeal.”

I thought that LACS response was especially pathetic.

‘There will be more prosecutions’

No shred of remorse that they have without any doubt at all besmirched someones name with no justification for the past two years. If they had any honour at all they would offer a full apology.

there people have no conscience whatsoever.

It makes for a refreshing change: the antis having to prove us guilty rather than we having to prove ourselves innocent. I wonder how much this case cost LACS.

Well done Tony indeed! And well done to the Judge for a fair and impartial judgement. Unfortunately, a successful appeal rarely gets the publicity that the initial conviction does, but hopefully this will prove a further embarrassment to the tossers in the Government who try to insist this is a GOOD law!

The LACS has done Wright and his chums at the Exmoor Foxhounds a HUGE service by exposing the risks of hunting outside the law. Wright should be thanking the League rather than weeping in court.

More than they can afford! :grin:

Don't forget that they are in dire financial straights. They have been loosing members at a very rapid rate of knots as are actually struggling to pay their bills :grin:

I feel another Christmas appeal coming on :grin:

I have been saving my old copies of Sporting Gun and the Yellow Pages for just such an occasion. :D
 
Yes, is it really two years ago since I was wrapping up telephone directories, old Argus catalogues and anything else I could lay my hands on? Luckily my husband is a hoarder so there was plenty of donations to be gratefully received.

Have the Exmoor Foxhounds hunted outside the law ?

I don't think so !!

I think Mr Hobday and Mr Batchelor should be very carefull about wasting police and CPS time.

I think only a custodial sentence would help them understand.
 
As long as Mr Wright operates within the law from now on he has nothing to fear from the League. So if you bump into him please tell him to dry his tears.

However, I would hesitate about breaking open the bubbly just yet if I were you. From what I've heard there will almost certainly be a further appeal and that could well establish a definitive judgement in the High Court you won't be so pleased about.

Which means making sure he shoots all the foxes he flushes out. The reason LACS prosecuted him was that several foxes escaped.

One minute anti organisations are supposed to be awash with money and the next they're skint - of course it all depends what suits your argument best at any given time. I guess you believe the same is true of IFAW and the RSPCA as I'm sure they'd like a defintive judgement from the High Court on this as well. (:grin:)

Who are this "Your "you refer to?

I for one have always been specific about who has funds and who doesn't.

IFAW Are reasonabley well funded. Principally by US and European animal rights activists and pressure groups.

RSPCA Well what can you say they are the biggest bunch of fraudsters going. Regularly contriving their charitable status, spending funds directly supporting politicians and political causes. Promoting a public image that they don't privately live up to and never intend to. Publicly chasing every penny that they can and pleading poverty and then privately squandering hundreds of thousands if not millions.

I'm sure they would like a definitive court judgement, but they know that they're never going to get one. Thats why they are slightly ahead of the game when compared to the LACS.
