A gate was placed across a wide path in 1990 that had been used for many years previously by walkers and horse riders.
I embarked on collecting 'User Evidence' from people that had used it so that I could apply to Hertfordshire County Council to have it recorded as of Public Byway status n the Definitive Map of Hertfordshire. (This is the County record that records all the Public Rights of Way within Hertfordshire).
I collected Evidence Forms from people that had used this path as far back as the early 1920’s.
In October 1997 I submitted a formal application for a Definitive Map Modification Order (DMMO) to Hertfordshire County Council to have it recorded as a Public Byway.
As after 10 years I had heard nothing about the progress of my application, I wrote to Hertfordshire County Council in October 2007 requesting an update and was advised that it was in a list of applications awaiting to be considered.
As I had heard no more In August 2017, I again contacted Hertfordshire County Council for a report on my applications progress and was advised that it was on the list of applications waiting to be considered and that it was number 34 in the que and that it would be at least 3-4 years before it would be considered.
As 20 years had passed, I went out and collected further Evidence Forms which I again submitted to Hertfordshire County Council.
In January 2018 as no progress had been made, I made an application to the Planning Inspectorate (PINS) to request that they instruct Hertfordshire County Council to progress my Definitive Map Modification Order (DMMO) application.
I then wrote to the Planning inspectorate on 4 more occasions to determine on their progress.
In August 2018 the Planning inspectorate advised Hertfordshire County Council that they must progress my Definitive Map Modification order.
In June 2019 I contacted Hertfordshire County Council asking for a report on progress and they advised me that they were about to progress the matter by investigating the evidence supplied by me and any historic documentation held in the County Archives.
In October 2019 Hertfordshire County Council published their report supporting my application.
In February 2020 Hertfordshire County Council published their Modification Order Application Decision and decided that the path should be recorded as of Bridleway status.
Hertfordshire County Council made their Order on 12 May 2022, however there was an objection which was subsequently withdrawn, and the order was published on 10 November 2022.
The path has been recorded as ‘Clothall 30 Bridleway’.
I would like to thank all those that completed evidence Forms, Dr Phil Wadey of The British Horse Society for his advice and support and Hertfordshire County Council for processing my application.
It may have taken me 25 years to get this path recorded as a Public Bridleway, but future generations of walkers, cyclists and horse riders will be able to continue to use it to access the beautiful countryside of the area.
