Agree with Annagain, got to be worth a try - if she had 100s of ebayers after it, she should be able to sell it ok.

If not a lesson learnt in taking a knowledgeable person with you - I once got about 2/3 off a motorcycle by taking a guy who owned a local motorcycle shop with me - he test rode it while seller said 'Isn't that xxx from yyy shop?' and looked worried, he came back and sucked his teeth and said we needed to talk, so we went in a huddle and Mark said offer 2/3 the selling price (which I thought FAR too low) as a starting point, having pointed out 2 or 3 minor faults (like broken brake lever), amazingly the seller just said OK: what a result!
 
If you do go ahead and send Stacie & Jed's wording please look at the grammar, spelling etc. I've never heard of being "lulled in to a false sense of pretence" before and "tires" should be tyres. Sorry to pick holes but it needs to be correct if you are sending that sort of communication.

No, don't send that email.

The seller may not have been aware that it wasn't an aluminum floor if they were sold it as having a wooden floor in the first place. She maybe did the same as you and didn't check.

It is down to you to make sure things are safe before you let your horse into the trailer. Things like bald tyres should have been picked up before you purchased the trailer, and as the flooring is such a crucial part of a trailer, I'd have thought you would have checked this thoroughly first too.

Ebay will not take any stance as the transaction was carried out outside of ebay, so why should they get involved. Also the fact that you signed a note saying "sold as seen" limits any legal comeback.

I hope I'm not coming across as too harsh. I am sorry you were 'ripped off', but as trustworthy as the person may have seemed, you have to treat everyone as if they aren't in the first instance.

I think you will have to put this down to experience, get the floor sorted, then enjoy your trailer

Get a copy of the original advert which states Aluminium Floor.

If all else fails take her to the small claims court for the amout it costs to install an aluminium floor.

Don't make the mistake of thinking that Aluminium Floors are safer than wooden floors - they are not. Aluminium can degrade as a result of contact between the aluminium and the steel substructure as a result of urine creating a galvanic action between the two metals at their interface.

Whatever the floor and ramp is made of check it regularly from above and underneath.

Also make sure that you fit trailer tyres and not car tyres when you replace the tyres. Pressure should be at 50 p.s.i.

Purchaser signed as 'sold as seen', think caveat emptor may apply here. As to the misleading ad it may have been a genuine error, after all its not the easiest thing to disguise with a purchaser who knows what they are looking at.

A quick phonecall to the seller will give a very good idea of whether its worth persuing this but I have a feeling you could be peeing in the wind on this one.

Not everyone in the horseworld is nice and its worth baring that in mind when you are buying or selling. Dont take anyones word for anything, you may end up looking a bit 'sad' but its better to check.

Ooooh, you should never do that! Although Im sure you realise that now!! I'd probably just give the woman a call and tell her, see what she says. She might offer you some money back.
 
I don't think the seller was "trusting"!! maybe "trustworthy" and the buyer was the trusting one!
I definitely think a call to trading standards won't go amiss, they will tell you either way if you have any comeback for the trailer not being as described.
I would also query the age, can't remember when Ifor stopped putting in wooden floors but I am pretty sure it is more than 8 years ago.
Incidentally, even if you had bought it through ebay, if you paid cash they will do absolutely nothing. I know this as fact after we bought a dodgy TV and they said terribly sorry but nothing to do with us.
 
It is buyer beware but as it was a private sale it does have to be as discribed, get in touch with trading standards they will advise you. But first write a polite letter to the seller allowing he or she to reply. It only has to be suitable for purpose if it is brought from a business it doesn't apply to a private sale.
 
"Sold as seen" is utterly meaningless in the face of an express statement to the contrary (i.e. wooden floors instead of aluminium ones as advertised); although you didnt complete the transaction through ebay so cant ask them for help, you can still rely upon the terms of the ebay advert to show that false representations were made.
Sold as seen may or may not cover the damage to the wooden floor, depending on a number of factors such as whether the damage would have been visible on a reasonable inspection (not sellers fault that you failed to make reasonable inspection), whether the seller was aware of the fault, and the extent that the damage affects the overall state of the trailer (i.e. if cosmetic damage/floor will need replacing next year the seller is probably covered by SAS; if seller was aware that the fault was of sufficient size to make the trailer unsafe to carry a horse, then probably they are not covered).

Ultimately if you want your money back and have a copy of the ebay ad saying aluminium floors, you are almost certainly to entitled to it (tho I would not expect them to pay the costs of your journey to return it).
Just send an email saying you have had chance to take the mats up now, that it doesnt have aluminium floors as specifically specified in the advert, so you would like to return it for a full refund. No need to go into detail about damage to floor, guilt tripping seller etc. just mater of fact need to return it.
