Ginger monkey - you are not alone in this I regularly get situations where no evidence just one word against another persons and they go to court and the insurers advise to settle out of court, the company I work for a large construction company have gone to great lengths to select an insurer who will work with us and we have set a standard to fight these spurious claims, in the long run it will save us and set a precedent however in the short term we are experiencing excessive court costs!!
I think we should change the law to be more like america ie disclaimers being legal and people sign to say they understand what they are taking part in may be dangerous and they are resposable for themselves...... the other thing is make people take out there own personal insurance so if you have an acident you claim from your own insurance ,then if it is a genuine claim your insurance will chase the 3rd party, like car insurance does otherwise you lose the no claims discount hopefully it would stop the large number of people "trying it on"....
