insurance! advice please!

I have a couple of people riding my horses and have just discovered they are not covered on my policy unless i name them and pay for them!

I am going to send them this and advice they take out rider insurance.

What do you think of it?

Any help or suggestions would be gratefully received!




INSURANCE DISCLAIMER


Horse riding is classed as a high risk sport.

My horses are insured under my policy and in the event of an accident they and any third party are covered regardless of who is handling or riding them.
However only I, the owner am a named insured rider.

Therefore I would advise you take out your own rider insurance to cover yourself in the event of an accident.

By signing this agreement you accept full responsibility of any accidents or injuries and understand you are not covered on my policy.
 
Now, I could be totally wrong, but I'm sure I read a thread a while back when someone in the know said that disclaimers aren't worth the paper they're written on. She said that if you could be seen to have been responsible for an accident (even if not present), that it doesn't matter what the person has signed. In the eyes of the law, you are still responsible. Utterly ridiculous and therefore probably true! I don't let anyone ride mine unless they are insured and I'm a gold member of the BHS which I believe means anyone riding my horse is covered.
 
NfU have told me the horse and third part will be covered on my insurance just not the rider if injured.

God im totally confused now!

Dont want anything to happen then find out we are not covered!
 
Just tell them that they have to get their own personal accident cover...

I never have that on my insurance policy anyway.

Do you not have them sign a loan contract? Or is it not a loan?

Ive told them they need their own insurance but i thought a disclaimer would be a good idea in case they didnt take up my advise and get their own insurance.
 
LindseyH - I think you are talking about liability claims, essentially all liability claims hinge on whether negligence can be proved.

If the owner can be proved to be negligent then it won't matter what disclaimers have been signed a liability claim can be brought against her.

This area is a total minefield.

OP - if you have it in writing from the NFU that your horse is covered for third party accidents / injury / liability then you are fine from this angle. However I would take legal advice on your personal liability if a rider is injured whilst out on your horse & what steps you can take to protect yourself from claims. If you have household insurance you may have legal cover included in this so give them a call and see if they can help.
