As I've not gone with the surgery for my mare for the ks as it is a small chance she will be a riding horse I just asked my insurance if they would do a loss of use for her but they have said that as surgry is a option, even a small one, they won't do it until surgry is done and it doesn't work......

Surely it's best to decide what is fare for the horse......oh well it was worth a try:0

Have another chat with them. Work out how much the surgery and all associated bills are likely to be (assuming that they are covered by the insurance), speak to the vet about the chance of success and then see if you can negotiate something with the insurance company. At the end of the day insurance is a business and if you can show them that the chances are they will pay for the surgery and then they will still need to pay out on loss of use then any decent insurance company should at least have a conversation with you about it. You may need to negotiate a bit and take a slightly lower pay out than you would get if you went along with surgery etc but if you really feel that it us best for the horse not to put the horse through all of that then it would definitely worth having another conversation.
