irresponsible selling (sorry long)

firstly, if you sold a horse and delivered it to a yard where the person buying it had no hay, no straw and no feed for it and their response is or il try and get some in the morning, would you leave your horse their?
This happend last night, I still cant quite believe it, the full story is the mad goat woman finally came to get her stinking goat on Sunday, she then asked how much livery was, considering shes paid bot all for her goat for the past 4 months, you can imagine i wasnt to keen, turns out she has bought a foal and it was to be delivered soon and needed somewhere to keep it, its a colt and shes keeping it as a stallion to breed from (she has never owned a horse in her life and from past experience from her goat caring skills its like argh), i explained to her, i dont have the facilities to care for a weanling thats why my mare and foal are not on our yard and explained to her why she shouldnt be breeding and how difficult stallions can be to handle and that no way would i keep a stallion on my yard, i honestly thought i had got through to her
Well 4pm yesterday i got a phonecall, her foal was on its way to be delivered she needed some where to keep it as she had nowhere (apparently she has got some land but needs fencing and thats where the goat is), i told her to tell them to turn around and go back home until she got sorted, she said they wouldnty and would only need the stable for two weeks, as she has got someone coming to fence for her, stupidly i told her to go and get hay and straw and find out what feed it has been having and i wanted money upfront for the stable, the foal had to be gone after the two weeks as this isnt anywhere near for a foal
I went to view a house after work then made my way upto the yard, well no sign of her, no hay, no straw, no feed. I tried ringing her surprise surprise no answer, so i thought maybe shes just mad after all and was having a senile moment. The a horsebox comes along the track from a well known stud, with the mad goat woman sitting in the passenger seat, they all got out and i asked wheres the hay and straw and the feed, infront of the sellers, her reply il try and sort some in the morning, i was honestly stood their like

they still unloaded the foal and popped him into the stable, took some straw off the wagon for his bed and i had to empty the last bits out of haynets for the poor little thing, i spoke to the sellers and said seriously shes mad and hasnt got a clue, their response shocked me as much as hers, we thought that she turned up 8 at night and said i want that foal paid and disapeared!!
seriously i could have slapped them or perhaps should have, i would never leave any horse in a situation like that, i should have told them to take the foal back and it wasnt welcome but i got that much of a shock by their attitudes it quite dumbfounded me, is it just me or is this bad

That is shocking?? Firstly why would anyone whos never had horses before go straight for a foal least of all keep it as a stallion and secondly OMG! I canntot belive that the sellers would leave the foal there but then again some breeders purley are breeders they get their money and thats it unfortunatly.
Lets hope for the foals sake she gets him all sorted today and hopefully she can handle him when he gets older and the old testosterone starts pumping.The most annoying thing is if she dosent teach him manners or train him properly surly hell be a danger.? Sorry I do not know an awfull lot about Stallions either.

Poor foalie! The woman is clearly not entirely all there, but the sellers are very irresponsible because they should have known better.

Why do people do such bizarre stupid things?

This 'oddball' of a women is clearly mental and now I can only dread about the poor life her foal and subsequent horses are going to have!

What can you do though?
 
Personally I would be ringing the WFW and telling them the situation - even if they won't do anything now, they could maybe agree to monitor it or even better, take it away now before it is totally screwed.

If it is not with food tomorrow, call them again and say it has been dumped with no provision and can they come and take it on ground that owner has left it wthout food or water and that you will not provide it to force someone to care for it responsibilty.

My blood is boiling as I type. Usefully f***ing people - should not be allowed a goldfish let alone a horse.
 
well we were up this morining and she hadnt been then, so weve put fresh water in and borrowed some hay from neighbours, which we will have to give them back, i was gobsmacked now im p****d, theresa_f i never thought of ringing them, i will definetly be calling them, ive tried ringing her but again no answer, ive also rung my feed merchants (only one around here and 5 mins from the yard) she hasnt been in to get any feed, i cant even write down what i feel at the minute as words cannot describe

No welfare charity can just come and take an animal away - the law doesn't work like that (we've been here before, ho hum...). But they can advise the owner and monitor the situation, as you say. So it's not a matter of won't - it's a matter of can't.

The only way they could take it would be for the owner to voluntarily sign it over, or to successfully prosecute the owner for neglect / abuse - just taking it would be stealing

Sorry I am getting set in my ways and I could just about remember it had two Ws - still want to refer to ILPH.

OP - I would now be making calls and stating that the foal is without proper care and that it is in your yard unfed and unwatered and what should you do as you are not prepared to take any action.

If they will not, get it on a trailer and dump it in with the goat and let the stupid bitch deal with it. Personally I couldn't as I am too soft but this might be the only way to bring things to a head.

I would also refuse to let her have the foal back until she has paid all livery and costs you have incurred.
 
you will need to double check these facts BUT I think the law is that if an animal is dumped then becomes the property of the landowner after (want to say 2 weeks). So, get some advice, show that the foal has effectively been dumped on you and give this woman notice that you will sell said foal on in x time. Might even be worth calling the RSPCa to see if they can confirm the legal terms. Whatever you do you should definately keep a legal listing of ALL costs incurred which includes your work as well. I got pulled into help when 2 shetlands were dumped on someone elses land and that is how the RSPCA managed it with us.
