Is my livery yard owner negligent

When I initially read the post I thought the outcome was going to be that these horses were put in her field and had kicked her horse.

Yes, this is exactly what I was expecting to read too.

As far a negligence goes:
a) Sprayer could be, if field was small and horses unable to escape from spraying water.

b) Turning horses out in a field next to your horses is not negligence, I think any judge would assume this to be perfectly normal

Sorry you are having a torrid time, however some youngsters just seem determined to try and kill themselves and not necessarily with a good reason. Our liveries 3 year old managed to just fall over in the field and rip a huge 6" gash behind his elbow. Nothing to catch it on, just a freak accident because it was a highly strung youngster.
 
I think she is asking whether it was negligent to turn out a new horse next door to a convalescing horse without informing the owner. I think it might have been more courtesy rather than negligence.

Trouble with yards is that on a lot of them, the YO employs the "my yard my rules, you dont like it, leave" philosophy which means they will do things without consulting the relevant owners first. I think she ought to have told the OP that a new horse would be put into the field next door - that way OP may have decided to put horse out and stay there to check that horse was ok, or to keep horse in if she felt that horse might go mad. Not sure that this amounts to negligence though (although arguably the sprayer would, particularly as it isnt a standard device used to water a menage etc).
 
Another word of warning if you are in an area where there are only few livery yard options and you have 5 horses so need quite a few boxes and you do go ahead and sue your YO for negligance then you might find yourself in a situation where other local YOs will refuse to accept you and may see you as a trouble maker as word soon gets around - don't presume YOs do not speak to each other!

If you go ahead and take legal action I would find another yard beforehand as the YO understandably will not want someone on her yard who is looking to take her to court!
 
I don't think you do I am afraid. I would check your contract though which probably states something along the lines of your horse is stabled there at its own risk kind of statement.

I put my youngster in livery where the owner was negligent.. things like turning 6 boy youngsters out in menage with no water or hay for hours on end. they would be so bored they'd start having a go at eachother. In the space of a month mine had pulled a shoulder (vet bill) gone through about £250 worth of turnout rugs and was extremely thin! The school was so deep its a miricle there weren't any more serious accidents. If she chucked them in the indoor school it was with their indoor rugs on so they were all torn and filthy.
The final straw came when she left some old clips in the stable she put him in and he sliced his nostral on them resulting in a little bit of surgery and now he has a permenant scar on his snozzle! This all happened over a very short period of time at which point I handed his one months notice in and moved him before anymore accidents occured!

I forked out over £1000 in rugs and vets basically down to her negligence which is outrageous but I shifted him pretty damned quickly and as soon as I could!!

You could always file a small claims because she can always object it and then you can make an appearance in a local court for a judge to decide. perhaps call them.. no idea though if it would work.

I hope you youngster makes as good a recovery as possible its a horrible thing to happen.
