Is this 'theft' ? What to do?

I have 3 saddles which at present are with a saddler for reselling on commission (I have a receipt).

I have asked and asked for them to be returned. I have sent a recorded delivery letter to both his business and his home, which I know he has received and read, and have left a message on his answerphone plus texts repeating the deadline I set for their return - which has of course been and gone.

If he doesn't return them (how much time do I give him?) would it be considered as theft? Or something else? And if yes its theft, would I go to the police or someone else?

This is when I wish Grant Mitchell was my big bro

Any advice / experience / horror stories, please let me know.

you have the documents of the recorded letter, I'd go to the police as this in my eyes is stealing. He's most probably already sold the saddles and is in debt. If they are there and no sale Why hasn't he responded???? Go round to his shop or what ever and as for them back
 
Are you expecting him to send them to you? Go andc ollect them. If he refuses to hand them over then, yes, I believe that is theft.
 
No I don't expect him to send them to me but I started by asking him to drop them round (he did with one other earlier in the year that I needed back). Unfortunately this is part of a bigger issue in that he also has to reimburse me for some other work that was done to remedy his screw ups, and he has to collect a saddle and give me my money back. But as I can't seem to get anywhere with the larger problem I thought I'd tackle the issue of the missing saddles which doesn't involve any money changing hands. I have suggested meeting somewhere neutral, and offered to come to his house to pick them up, but have had nothing back from him.

Typically his 'business' premises is not a shop / office in his name, but he has the use of another tack shop's saddle stock so the saddles may be there or may be at his house. I am in contact with the shop to see if anyone there can find them but his reference system is not theirs so they are coming up blank.
 
Yes - this could be theft.

You need to report it to the police and you need to show how long 'a reasonable' amount of time is that you have given him to return the saddles to you. Also, keep copies of all emails, text messages etc.

Aw bless her! I bet she's gorgeous really.

When my daughter was about 6 months old we were on holiday and she was wearing a pink flowery dress with ghastly matching bow in her hair, and a man in a restaurant looked at her and said 'oo what a handsome little lad'......I mean, really?!
 
ClipClop - you made me laugh out loud saying your baby looked like Phil Mitchell, but on reflection I guess Phil Mitchell does look a bit like a baby, all round faced and pink, so not so awful after all
