Call me thick but are the German National federation actually appaling for a stiffer penalty??? The way I read it they are calling for "stronger sanctions". This has made me slightly confused!!!!
Could it be they're asking for more definitive rules......? The whole thing is such a cock up anyway, and I don't believe for a minute they want their rider banned further?
Perhaps the FN has more information than could be supplied to the FEI or is not pertinent to this case? In which case they may have a vested interest in a harsher penalty. They can't sanction him any more than the world body without opening themselves to legal action or simply having him leave the country to compete, I would have thought, so perhaps they are pushing for a harsher sentence to avoid that scenario.
Or maybe it's politics. It will be interesting to see what inside information comes out of Germany.
Doesnt need inside info that one -Yup, German FN feels 4 months ban is not hard enough a sanction. And yes they've already announced that he wont be selected for any national teams for two years, and guess he cant sue his way into that one if they dont select them, then they dont select him, end of that story.
They received the FEI-decision protocol, and felt they had a chance to appeal that decision, in order to ban him for longer - as based on the evidence the FEI provided, just that would have been possible. Unfortunately they cant ban him themselves, as they lacked that point in the contract all the German riders had to sign, prior to the Games.
And I guess thats what it really boils down to: On that paper, they all pledged they wouldnt use any substance without supervision by Team Vet(s). All the german horses were tested for substances by the FN before they left Germany, and again after arriving in Hong Kong. Negativ all of them then, Coester included i.e.. Then all of a sudden positive when tested during competition. Ahlman put the substance on Coester by himself, he does not deny that. Now no one believes hes that stupid to make that decision and to take such a risk to ease some Coester back pain! And they're just furious about it, can't blame them I guess.
well if that is the case they will lose because the FEI are on pretty shaky ground with the whole testing thing anyway. i cant remeber what Ahlmann said about the reason for his positive test, denis lymch said it was a back rub but rodrgo said it was not even something that was being used on the horse but some cream the groom used on himself which because it is transdermla provided a slight trace. will be happily corrected on that cos rodrigo been saying quite alot on the subject i might be getting confused.
as far as i know all the tests were only for TRACES of the substance which is very commonly used in a great many things and for all we know some horses may well be suseptable enough to it to pick up a trace if they chew their doors treated with the preservative containing it whereas others do not.
if the german federation win at CAS then where does that leave the others already sentenced? and as i keep sayingthey didnt test them all when the initial four were found only 15 of those competing which means chances are there were a few others that were missed. and Rodrigo's horse was tested (along with the medal winners) immediately after the individual final so you would think if the product was used to 'hypersensitise' which as has been said requires doing almost immediately prior to jumping, surely his horse would have shown up more than a trace?
as far as i can see the whole thing is a legal minefield and a mass ****up.
