Jodphur question

All my jodphurs have knee patches and I thought this was the norm but I have recently bought some via the internet and they don't have them. I'm not happy but not sure whether to argue about a refund. The ad didn't state they had knee patches and you couldn't tell by the photo whether they had them or not but I just presumed they did. They are also far too big for the size stated on the label as I've worn 26 waist for years and all my others have fitted nicely. What should I do?
 
There not fit for purpose,too big and no knee patches.....return and ask for a refund,your within your rights!

No problem, don't mention knee patches, just tell them they're too big and you don't want another pair and you would like a refund, it's consumer rights.
 
They were from ebay. They did offer me another pair but they looked awful. Just asked again for a refund but I suppose I'll have to try and sell them on again.
