Not sure how long this will turn out.. but hey! Need to let it out..

Basically, I helped this woman out for almost a year, she had disability problems but had a few horses that I ended up riding/working with. She got us there I did the work, yeah you get the gist.
Anywaaay..

She always knew I wanted a pony that I could bring on, do showing in-hand, eventually break to ride+drive (as getting a small jockey was possible)

We'd spotted this stunning (I mean stunning) welsh a colt.. Rising 3yrs.
His owner got him for a companion didnt realise what good breeding he had and was selling him for a ridiculous amount of £75 :eek:

This is the bit now where people may rant at me..
Me and the woman agreed that he'd be mine if I paid for the travel expenses inc. trailer, petrol and a driver.. Oh and a months upfront rent.
Which in total added uptp £150 -£200.
She paid the £75 to the owner of this pony as she didn't have the fee's for the expenses I paid.

Anyhow, got the pony home he was a little ***t i'll admit, I was willing to spend most my time with him if I wanted the best for him, i'd still help with hers.
She let me sign the passport, my address etc..
We then had a disagreement as I had to stay on at college late one night for interviews and assessments.. I explained I wouldn't be able to get there that night, but theres a feed ready for the pony if she could just give it to him.. After all the times i've helped her I thought she'd agree.. no!

She decided that I weren't to have the pony anymore and that she was going to keep him an bring him on as I hadn't paid the £75?! :eek::confused: When we agreed that he was mine.

She's now still trying to sell the pony 7months on, for not even half the price he would be if I kept him and brought him on. She's slagging me off too saying I let her down and she can't afford all her ponies anymore.. "/

There was no written agreement between us which is where I went wrong. I just wished it'd work out perfectly wanting to give that lil man a loving home for a while..

Im expecting some criticism but please, not too much. I know theres mistakes I just needed to off-load.

The passport is in your name? Never was in her name?
Do you have proof you paid the transport costs? Proof you have paid for feet, food etc.?
Proof may be in bank statements showing withdrawals, receipts or people whom you paid.

Court might find that you had a verbal contract with her.

Worth getting advice on.

I've seen her bitching about me on the internet, not had verbal contact since the day this happened.
The passport has always been in my name, so she's either got a new passport or trying to sell him as me.
I'm pretty sure I kept the receipts and things, i'll have to dig them out.

Chalk it down to experience, and if you want the pony then send someone to buy it on your behalf. Even the nicest people in the world can change...
Don't let her get to you, her ponies are her responsibility not yours, and help stops arriving when you abuse trust and blind faith.

The police would have no interest in this at all - as ownership can't be proved. Unless the 'woman' has a receipt for the pony, in which case the pony would be recognised as being her property. To remove the pony, at this stage, would be theft.

I know nothing about these things but my gut instinct is that if your name is on the papers then he's yours, regardless of who paid the £75. Unless she has a written receipt to prove that she paid the £75 for the pony then it would appear that you are in a stronger position.

As a comparison, I could go and buy a car tomorrow but if I put someone lese's name on the paperwork as the registered owner, then it's their car regardless.

How about a quick call to the citizen's advice bureau as a starting point?

If there was no receipt for the horse then i would think thats proof enough.

And when mum divorced dad there was question over ownership of a dog if mum could have had it then she would have been able to have it because her name was on the pedigree. the police were there and told her so.

And if she requested a police escort to pick up the horse because she was being obstructed from doing so then they should take an interest- have done alot of this this year cos of mum and dad and had several police escorts :(

Amy may is a 100% correct. Passports even state they are not proof of ownership. I had a mare given to me and passport my name. Woman who gave her to me took her without my knowing / permission. Police said they would not act unless I had a receipt.

I do sympathise with what has happened but if all this went off over 7 months ago then is it really worth the headache/hassle trying to do something about it now?

Really? I didn't know you could approach Defra with this sort of thing - mind you I did say I knew nothing!

It sounds like a difficult situation, but if you really want the pony could you afford to buy him from her? Make sure you get a written receipt if you do!

Well i do think what you did was abit daft however i agree that unless she has a receipt of purchase she has no proof that he is hers, as for passports im not entirely sure that people keep up to date with these when it comes to changing owners names, i know my mum sold one of my horses whilst i was away and it was my name on his passport and yet nothing has every been said about it and i havent technically signed him over. can you not offer her the £75?? and if you have been paying for livery and transport and now she is saying the pony isnt yours then i think you need to type up all costs you have paid and send her a bill for them, it may make her rethink keeping the pony herself!! hope this helps.

I would steal him back one night. If she has no proof of ownership either and you are on the passport id say that stands in your favour.

Actually I think I am with the "steal him back" camp. Then it will cause HER the grief to try (if she really really wants the hassle) to get him back rather than it being your problem. You need the passport too though somehow.
I am sure you wont make the same mistake again anyway!

Steal it back??? Not a course of action that I endorse at all. I do wonder if there is more to this story than meets the eye. Why would the OP not have paid the £75 in the first place? Presumably the previous owner thought they were selling the pony to the one who stumped up the cash?

Leave it or buy it, OP, unless you want to be justfiably billed for all the costs of keeping the pony since he was purchased. That would amount to far more than his current sale price.

Let the pony go,stop helping the woman and her horses. Concentrate on your studies,take a good English course,pass exams,move on and do well in life.

Thanks for all the replies guys.

I've paid for 3months livery and feed and the rest she has. Wasn't particuarly asking for answers just to off load. You've been a great help!

I would have him back in a shot, but right now financial costs just wouldnt suit. I just hope someone out there will see him as I did and snap him up fast and treat him with the repsect he needs.

I won't be making that mistake again. x

omg i know the woman you are talking about does her name begin with 'C' by any chance? use to own a standardbred? absolute lunatic and con artist. she never had disablities when i saw her at clitheroe last year, was walking around fine and no bandages on at all! yet a few weeks before was hobbling and covered head to toe in supports. pm me if you like
