Legal advice after horse injured by poor fencing

Hello, My horse had to have over 20 stiches above his right eye yesterday after he got caught up in razor wire which the farmer had put up above the fence. the razor wire was looped in extremely large loops so any tall horse could put his head into the loops. Is there any legislation regarding unsuitable or dangerous fencing at livery yards so i can try to get compensation for all costs from the livery owner.

had you questioned the use of this wire prior to turning out in this field, or was the wire added when the horses were already out?
 
The yard manager always rides around the field looking for any bad fencing etc before horses go out in the field. She did not know it was there so allowed the horses go out. We have been in the field for a few weeks now
 
My friend, whose horse was in livery at a farm, turned her horse out in one field and someone!!!!! opened a gate later in the day and let the horse into another field. In this field was a plough! Her horse was found later that day with his tendon cut right through and had to be pts.
She got legal advice and spent money because she was told she had a case.Then it was found out that the farmer was insured with NFU and they said he wasn't covered for horses on his property! She never got a penny because it meant sueing him personally and she was told it was not worth it! He said another livery did it but there was no proof as the other liveries were children and they wouldn't say what happened [looks like they wanted to ride in that field and let him through so they could ride]
I hope your outcome is better in the horse recovering and getting compensation. She had so much heartache
 
My understanding is that if you are on DIY livery then you have the responsibility yourself to ensure that the fencing and surroundings where you turn your horse out is suitable.

But would definitely seek legal advice to get the absolute correct help here.
 
Were you aware of this wire before your horse was turned out, and were you then willing to turn your horse out there? if so, I think you have accepted the risk and the landowner is not liable.
However, I may well be wrong and would strongly suggest you seek legal advice.
 
Well I personally would be checking the fencing, weeds etc of any field before letting my horse in it. You have to take a bit of responsibility of these things yourself as owner...in my opinion.
 
Depends if you like where you are and want to leave?

We had a livery whose horse which had sweetitch cut itself scratching on the fence somewhere - no idea where as the field had electric allround. However she presented us with the bill, we gave it to the insurance company and they said that we had to pay it and it was not worth fighting.

As the excess was £1k we had to pay it ourselves. So you will get your money, but you will probably end up needing to find a new yard.

After that happened we shut the yard.
