I recently purchased a horsebox from a good family friends brother so did not have a mechanic look it over as i trusted them !!! I p/ex my trailer and gave the remainder + VAT They wanted the trailer for themselves.
Anyway 2 weeks after purchase battery went flat so when we went to charge them we noticed that the beams holding the back on where corroded and we could see daylight. I phoned seller straight away who did not seem surprised and took box away and said he would repair and sell on my behalf. I asked for trailer back but he had already sold it. Anyway i have asked for some money to at least buy a trailer and twice he has promised and the money has not appeared. I never received the logbook and it is still registered to the seller but he has told me i have to keep insurance going. This has been a month now since the box went back.
Where do i stand ??
many thanks pm me if you prefer

If he is a private seller I imagine it is a case of 'buyer beware' unfortunately, as a buyer it is up to you to either pay someone or check over the vehicle yourself. The fact you traded back your trailer is irrelevant and I'm pretty sure he wouldn't have to give you anything back money wise. Would it be worth getting a quote from someone for the repairs? you must have been fairly happy with the rest of the lorry. Maybe you could try him for some of the costs but wouldn't like to say he would or should have to. Unfortunately, you won't be the first or last to trust someone.
Is he running a business? not sure if it would make any difference though, and i assume he is vat registered.

Have you got email or anything in writing saying he will give you the money? Could you try to get something? Speak to CAB, but I suspect you don't have many rights as it's just like buying a second hand car from a private individual.

He is a dealer selling commercial vehicles that is why i paid him vat. I would never had not had it checked but i trusted him as his family and mine are best of friends even sharing holidays. I am still insuring it but i think even that is void as the log book is not in my name.

Why does he insist on you insuring it?
Is the box worth repairing and keeping?
Will he be taking a commission on its sale?
If he is selling it for you, will he be repairing it to sell, and will you get the bill or if he's selling it as it is will you be liable for any repairs or comeback?
And, how much will you lose if he sells it on?
Sorry for the ?'s
