okay, after my last thread, lady spoke to police and agreed she would allow me to fetch the boys on x day at x time. This is private property, so I have stuck to what was agreed with the police. I've arranged livery, and transport, along with help so I can get my stuff and the boys quickly and get out of the way.

Now, she's saying I have to give her CASH tomorrow to have my boys! I pay in advance and she wants extra. There's no contract, so am I right in thinking I am not obliged to do this? I am reluctant to hand over cash as she'll just say she never had it, so have sent her a cheque. BUT she says I'm not allowed the boys, until it's cleared or I give her cash. With a padlock on the gate i couldn't even see to them, I can't muzzle or strip graze them. I've paid her literally to sweeten her so I can get the boys, but she's now saying no.

I've notified the police again, what else can I do? where do I stand?

Tell the police. Advise them that she is trying to extort money in order to release your boys and that you believe they are at risk of harm (if you can't control the grazing) unless you are able to get them immediately.

Never mind x time or x date. I would be there with a lorry today preferably with a police escort.

This. If you are all paid up - then just go and get them. With bolt cutters.
 
Tell the police, ask them to accompany you to remove the horses as soon as possible. She has no contractual right to any more money or to keep your horses as payment. Without a written contract she is in difficulty. You have paid all that you owe so what she is doing is extortion, ask the police to deal with it.

Don't use the bolt cutters, that could lead to a charge of criminal damage. Ask the police to attend. They will ask her to open the gate and if she refuses they will arrange access - using your bolt cutters if necessary.
 
I'm not legally trained (but used to work for the police as a civilian) and my feeling is that without a written contract there is sweet FA she can do really coz its basically her word against yours. Whilst not a similar situation, I had someone here to do work for which he agreed a price, THEN obviously thought about it and wanted ninety quid more; I told him to go to the small claims court if he wanted it, so there may be some mileage in you saying to her that if she wants more money out of you she should pursue it via the small claims court, rather than have a argument about it - this just might shut her up.

You'd be wise, as has been said, to have the police present just in case there's any hoo-haa about it and she makes any allegations, or a PCSO at the very least just to safeguard yourself basically. The best course of action is just to get you and yours out of there PDQ.

Without wanting to sound preachy, this is the sort of thing that seems to happen without a written contract laid down - and even if you do have a "contract", problems can still occur. I'm in the process of letting out DIY livery (just for two horses, nothing big!) at the moment and up till now - because I've known the people involved - I've never bothered with a contract, but after reading your story plus several others on this forum, I shall definately do so in the future, even if its someone that "seems OK".

The police are attending when we remove the ponies and she's been informed by the police that if she tries to stop us she will be arrested. They've phoned me and made an appointment. I want to make sure I'm within the law as if she starts her screeching I'm scared she'll frighten the boys too much before I travel them.


I will pop up piccies tomorrow of the boys safe in their new home.


I do agree re the contract, but i've never been in livery before. Only ever kept them at 'home' (dad's). But when I moved I wanted them close to me, and this lady was recommended.

NEVER again!!
