Just wondering if anyone can help... today we had a 13 year old with her Dad looking to move up to the livery yard. She was told by YO that she could hack out with us (all adults) if she wanted. However we are concerned about this- what if she has an accident whilst out with one of us, would we be deemed the responsible party and potnetially get sued? Also if she is up at the yard on her own and something happens could the YO be held responsible? As awful as it sounds none of us wants the responsibility of having to look after/ be held responsible for this young person.
Any info/ advice gratefully recieved!
 
My YO does not allow anyone under 16 up the yard without adult supervision. I'm sure she said this was because of her insurance... But I suppose policies vary.
 
Our insurance at the yard has just changed and now no-one under the age of 19 can be left unsupervised - H&S gone mad I guess...
 
Shouldnt she have asked you before suggesting this? What if you dont wanna go hacking with a child?
 
There may also be CRB issues. You have to be VERY careful regarding children these days.

We often ride with a 14 year old girl who is a really accomplished rider and my OH has also taken another 13 year old under her wing, but she is a professional teacher, who has up to date CRB certificates. Without this we would be on dodgy ground due to the girls ages.
 
Hi thanks for all your answers, rang BHS helpline and they said responsability would mainly lie with yo but im still not sure about this, I also didnt think about CRB thing which I think is something we on the yard have to bring up... I also have found out the yo owner doesnt have insurance...
 
You've definitely got to get this sorted before the new livery arrives. I would be very annoyed to have been volunteered as a "babysitter" for hacking without first getting to know the child and see how she rides. Is the child always going to be accompanied by an adult at the yard? If not who is supposed to help them if they get into difficulties? Or if you are the last one left on the yard with them, are you going to be expected to stay with them until the parents turn up?
Separate issue - If the YO isn't insured she wants her head tested.
