Can anyone help! I'm looking for a standard contract to use for my yard - I rent it from a local farmer, and as I want to start offering some livery I really want to make sure everything is airtight.
I'd also love to hear from anyone on recommendations for clauses, as I know there are many pitfalls.
My situation: I'm renting an 8-stable barn, about 12/15 acres of paddocks and a school. My partner and I are also building another barn. The farmer we rent it from is a 'friend' although as time goes by he is becoming less of one! It's been fine when it's just been my horses there, but some groundrules need to be written up before I have paying liveries. For example, I came to the yard the other day and there was a massive piece of dangerous looking farm machinery (a potato planter I think?!) parked in the middle of the horse yard, and then there have also been issues with cows in fields and so on.
Anyone else who rents a yard, private or otherwise, please share your stories! The farmer has said we are responsible for all field maintenance - topping, fertilising etc - is this normal?
I know that in landlord/tenant contracts, if the tenant breaches any of the terms they can be asked to leave. However if the landlord breaches any terms, what is the recourse? Do you deduct/withhold rent? For example, dangerous machinery left in the way etc - the kind of things that make liveries leave..!
