Livery yard agreement/contract with farmer

Can anyone help! I'm looking for a standard contract to use for my yard - I rent it from a local farmer, and as I want to start offering some livery I really want to make sure everything is airtight.

I'd also love to hear from anyone on recommendations for clauses, as I know there are many pitfalls.

My situation: I'm renting an 8-stable barn, about 12/15 acres of paddocks and a school. My partner and I are also building another barn. The farmer we rent it from is a 'friend' although as time goes by he is becoming less of one! It's been fine when it's just been my horses there, but some groundrules need to be written up before I have paying liveries. For example, I came to the yard the other day and there was a massive piece of dangerous looking farm machinery (a potato planter I think?!) parked in the middle of the horse yard, and then there have also been issues with cows in fields and so on.

Anyone else who rents a yard, private or otherwise, please share your stories! The farmer has said we are responsible for all field maintenance - topping, fertilising etc - is this normal?

I know that in landlord/tenant contracts, if the tenant breaches any of the terms they can be asked to leave. However if the landlord breaches any terms, what is the recourse? Do you deduct/withhold rent? For example, dangerous machinery left in the way etc - the kind of things that make liveries leave..!

Absolutely standard.

How does the farmer feel about you sub-letting?
 
Crumbs, I'd think long and hard about getting into liveries if you are already having issues with someone who used to be a friend and who is in ultimate control of HIS facilities!
 
It is a livery yard and has been for years, so that's not really the issue - it's just only been my horses since I acquired it a few months ago. However it was previously a bit of a run down, cheap yard and we're making a bit more of it.

The farmer isn't terrible, just a farmer - doesn't understand horses. Therefore I want to have an airtight contract which lays out EVERYTHING so there can't be any argument/falling out in the future!!
 
And as amymay says, are you sure he's happy about you subletting. A farmer friend locally is only too delighted to have got rid of his DIY liveries and to be letting his whole yard to one person at a reduced rate for a quieter life / less people on the yard.

In that case, I suspect some kind of agricultural letting agreement is going to be needed between you and the farmer. Your solicitor will be able to help with that one.
