Loan agreements and a passport question....

I'm just in the process of doing a loan agreement and am using the BHS template. Can I just ask a quick question though re passports. If you are loaning a horse who keeps the passport, you or the loaner??

Also what have people put re visiting to check on horse? We've put we can check on him whenever but for the first three months will visit once a month and would like regular email updates.
 
Is your horse microchipped? IIRC, even if the loaner has the passport, owner can be proved via microchip ID?? Don't quote me on that though.

I'd say you should keep the passport though, just in case.

Put something along the lines of you being allowed to check horse whenever, with or without scheduled notice, so long as you are within the yard it will be at's rules.

But also notify the passport office that your horses is on loan and the passport must not be changed, also contact freezemark and microchip company. if the horse has neither get it done. Also in every case of missing horses on loan when the horse goes missing it because the loaner has fobbed the owner off with a sob story that you would never question, so that you can't see your horse or why they haven't been in touch, usually lost a baby, daughter/mother etc has cancer, they were in hospital, son/baby/partner died, and the lies get worse when you do start to question them, if alarm bells ring there is usually a good reason.

We don't want to out anyone off loaning their horses, we ourselves have had loan horses and loan our own horses out, we would rather not be doing this job, good luck with your loan.
 
Mine states owner can come up annouced and unannouced, states all tack etc, what can and cant be done with the horse.
Passport I have a Copy, whilst owner maintains the original, they bought it over when jabs were due so it can be signed still.

Just read through very carefully, detail everything you have and its condition etc.
Where horse is to be kept and ridden by who, and insurance etc.

My friend has a horse on loan. She has a photo copy of the passport and the owner keeps the original. My friend doesn't travel the mare though x
 
Loner will require the passport and vet jab records.

I have just had my horse back from loan and I photocopied the above and kept them with the loaners sig and dated on them.

Also get witnesses to sign loan agreement one for you and one for loaner signed and dated :)
 
If you don't trust the loaner with the passport then FGS don't give them the horse! If they are the sort of unscrupulous person that is going to make off with your horse then not having the passport won't stop them....
 
The passports are supposed to be with the horse wether stabled on grass or travelling to shows. In theory livery yards should hold passports although I don't know anywhere that insists on this.
My horse that I put on loan I gave her the passport as my thoery was if I didn't trust her with what is essentially a piece of paper then I why would I trust her with the horse. I would photocopy the passport though just for your own reference and inform the passport agency that your horse is on loan.

Passports legally have to be with the horse. So if you are loaning out the horse then the loaner must have the passport. It is illegal to travel a horse without a passport. If you are asked to produce the horses passport and are unable to within a few hours then you can face a hefty fine. The keeper also needs the passport for vaccinations etc.

A passport is not a document of ownership, so if you do not trust the loaner to have the passport, then why on earth would you trust them with your horse.

My passports always stay at the livery yard with the YO. I take them with me when traveling to shows, and our lorry has been pulled over to be checked before.
