loan agreements what to include

hello peeps.
I know there are plenty of free lon agreememnts avail to download. But wondered what extras should be included.
Insurances etc.
Best checks to do so your horse doesnt dissapear etc etc

References from their vet and yard owner. Put something in the loan agreement that spells out in black and white that the horse remains YOUR property and cannot be a sold, b gifted c loaned to another third party. Have it in writing that nedomline will show the horse as an loan and the relevant passport office has been informed as well. It's spelling out the obvious in the contract as it would seem that the police will choose not to be involved as it can come down to a he said she said... So becomes a civil matter and really hard to legally prove you did.not give away your horse. Not being rude about the policei it be aware that often loan disputes will not be acted on by the police because of the reasons stated. Put all this into an agreement should as it should frighten off the bad guys, and demonstrate you are retaining ownership.

Im seeing more and more that its loaners job to sort insurance.
I was going to cont it but have that they paid any excess if god forbid it were needed
Any ides??

I have done both, my current loaners insure him themselves, but if you are concerned, ask to see the documentation. Also specify how often you want to visit, how much notice you have to give of visits, and notice both ways of ending of agreement.

Hi if you PM me your email address I can email you a copy of an agreement I draughted up... it covers absolutely everything! :)

Somebody i know insisted on financial reimbursement if the horse was returned late. So even if they sold the horse it would cost them straight away. The loan said £100 a day for no return at end of period of loan or after given notice for return. Basically if horse wasn't returned you paid otherwise loan was free. She swears blind it has kept all of her horse safe whilst out on loan.

I will pm you OP.

I've got a loan agreement I used when my boy went out on loan; basically, in hindsight, I would have added in a clause to the effect that the owner would NOT be held liable for livery fees should the loaner decide five weeks into the loan that she couldn't afford it!!! She hadn't paid a penny for my boy's keep; and I don't believe she ever intended to - she basically stuck her hands in the air and said Oh dear I can't pay/can't afford it. Wretched numpty girl.

THEN because it was cheaper for me to bring horse home to my own yard, I still had the problem of transporting him back.

So you need to think about this eventuality.

But I'll PM you. If you don't hear from me in a day or two please remind me coz gotta head like a sieve!
