Loan agreements.. What's the point!!

At the end of May I loaned a horse for 3 months, I stated verbally I may want the horse back after the agreed loan period, also stated in the contract the horse is either bought by loaner, returned to me or loan period extended.

After much begging, pleading and advertising I have finally found stabling and grazing near home so I thought it would be polite to let the loaner know I would be requiring the horse back at the end of loan period.

She has then offered me a small amount of money ( less than half the asking price ) which I refused, so she then accused me of using her for free livery ( I wasn't paying livery ) and she wasn't schooling my horse for then sending it back!! Erm she had it on loan as a hack..

So now I have to pick up horse asap and pay for shoeing!!

So much for a months notice either way..

So what exactly is the point in having a signed loan agreement?
 
I had same problem as this and took the girl to small claims court for breach of contract. If it was in the loan agreement and you clearly stated the price to buy before the loan started then the loaner has no argument. I went and collected my horse for fear of her not being looked after (she wasn't). Put it down to bad experience and small claims is always there if you lose out.
 
Yep I have heard lots of folks having problems with loaning. A friend had her horse on loan to a riding school and when she asked for the horse back they started becoming funny and told her she would have to take the horse or pay livery immediately. Although she didnt have transport she didnt trust them so she went and just got the horse out the field and with a borrowed box! End of!

Also a horse that was on loan with strict written instructions to wear grazing muzzle. Horse died of colic as the loanee put horse out without muzzle. Best schoolmistress they had ever owned, devastated!
 
It's really annoying, before she took the loan on I said it was subject to review in 3 months and I may want the horse back and she happily signed a contract stating the same thing...
I don't see anywhere that I am under any obligation to sell for what she was offering?
 
You are not under any obligation to sell, you have acted within your rights, and should take horse back asap.

You ask what is the point of a loan agreement, well without it, she could claim you sold or gave her the horse, if it is in writing and something goes really badly wrong, you have a much better chance of sorting it if the loan agreement is written not verbal.(Should legal action be required).
 
Thanks... I only picked up my other loan horse on Tuesday, it would have been preferable to have kept the horses on grass livery ( and cheaper! ) but nevermind..
 
I think you should take it as a compliment that this girl wanted to buy your horse though! She must be upset about the whole thing and perhaps thought that you wouldnt want to take the horse back after 3 months?

I loan a horse at the minute and i have a feeling that the owner may want him back at the end of our loan agreement (1 year), i dont have the option to buy, but i have to say that i would buy him, but after having him for 4 months, i have found out that he rears, has bad feet, likely to colic etc and i would in no way shape pr form offer the amount she says hes worth as when you look at him you might think that but hes not worth it when you know all the ins out outs of him!

Im not saying that half the price is ok, thats just ridiculous, but im saying that maybe think how this must be for her aswell, as it cant be nice having a horse taken off of you when youve spent a fortune on it and lots of time?!

Is she young out of interest?

Sorrry to hear its not gone smoothly, but at least your getting your horse back!
 
I will never loan another horse again....the person i loaned to wanted my horse as a machine,and i asked her not to and she wanted me to collect him that night at 9 30pm!!!Thankfully he is home now where he belongs
