Loan home refusing to give passport back

I would write a letter send it recorded delivery or even better if you have an email address send an email saying that you require it back within 10 days and if they do not return it within 10 days then you will assume that they have lost it and will be sending them an invoice for the cost of replacing it. This way you can sue them for the money if they are being idiots.

Tbh I wouldn't get the police involved all they will do is say they haven't got it and it will be a waste of everyone's time.
 
Refusing or being slow? My pony came back from loan and they returned him, I didn't collect him. They forgot his passport, and kept promising to bring it over etc. I was starting to get slightly panicked, as the girl who shared him with them visited and thought his vacs should have been done, but it was all fine, and just a case of life getting in the way. In the end I went and collected it.
 
I very much doubt the police will entertain the idea of coming with you to get it back.

Mention threatening behaviour and they'll probably bring out the armed response unit plus a couple of helicopters.

If in Cornwall, you're in the same police area as me, and I can tell you what they'll do which is the way they react to anything equine-related, and that is sweet FA I'm afraid.

I'd be inclined to do as someone else has suggested and send a letter recorded delivery, saying that you note they have still got XXX's passport and that now the loan is finished they will naturally be aware that they should return it to you forthwith and would they please do so without delay, or else you will have to get a replacement issued at cost to yourself, and will be seeing reimbursement from them for the costs thereof.

It is a nuisance, yes, as all your vaccination records will be in the passport and it is a PITA not having this to hand - but at the end of the day you can apply for a replacement one to be issued. But for me, the passport is a bit of a sentimental thing too so I'd not be best pleased at having to hassle someone for it. FFS what is wrong with people!
 
I dont see why you'd waste police time over something like this, Im sure they have more serious matters to do with. I would send them an email or recorded delivery letter stating that as per the law, they need to give back the passport within 10 days and if not received, you will assume its lost and will send them the invoice for the replacement. See what happens. If they dont respond after 10 days, then I'd send them another stating that as you havent had it back you have applied for a new one and here's the invoice to be paid within 7 days or you'll take further action.
 
OP does not seem to have replied to questions. if loaner, returned the horse without a passport, then Trading Standars should be your port of call, as they illegally transported a horse without it's passport.

As someone has said re Police, when it comes to matters equestrian there are too many 'do nothings' which is probably why the whole passport system in the UK is such a disaster.
 
If you need evidence of the injections being up to date you could also say that if they have lost it then not only will this incur additional cost for the replacement of the passport but it will also incur additional vet fees relating to either restamping the vaccination information or even starting the vaccination process again.

To be honest you haven't said whether they are refusing or just not responding , if the former then obviously your wording can be harsher if the latter then give them the benefit of the doubt and be fairly non-confrontational in the wording of your letter as this is more likely to get the result you want.
 
Its all a bit long winded. So in short.. Loan home took the pony back to the owner by hacking her. She has since said she has fallen out of contact (for reasons unknown) with her dad who is refusing to give her her stuff which includes the ponies passport. Having a passport re issued means the cost of the passport plus a veterinary call out to fill it in. The pony is now in my care as the owner had a baby and lost her grazing. I am keen to get a passport sorted but looks like I will be the one footing the bill!

I think I would contact the dad, and tell him it is a legal requirement the passport accompanies the pony, and if he wont return the passport, you cannot have an unpassported pony on your yard, and your will deliver the pony to his garden instead, for him to look after.

Might expedite his response!!

I wouldn't do this as if the dad is trying some emotional blackmail or similar by withholding the girls stuff, think how much more emotive a pony is. But I would send the dad the recorded delivery letter stating that the passport is your property, say about him being charged for a replacement and include a stamped addressed envelope for the passport. He's got no argument with you so will most likely send it back to save himself any further hassle.
 
Make it easy and non confrontational for the dad. Enclose a SAE and also describe or enclose a pic of what the passport will look like so he can easily identify it among the daughters belongings. My husband would have absolutely no idea what a passport looked like if he had to find one
 
Tell the father that the passport is legally the property of the issuing office or society, and that they may well decide to pursue him over it if a replacement one ends up having to be issued.
