Loaning horses out etc etc? (maybe long sorry)

Hey everyone,

I just wanted to know really, please don't put any bitchy comments!

Say if a person bought a pony .. and they then asked there friend if they could look after it for a while, and they didnt return, is the friend that is "looking" after the pony now the rightful owner? Without buying her etc. Even if they have a passport in the friends name?

Im just wondering really, because Gypsy's owners got left with Gypsy for about 5years they broke her and everything, and now ive had her on full loan for 2years. Gypsys passport was issued on the 10/01/2008, so where has she been for the past years? Does her owners have the right to put her out on loan/sell her? Her owners name is on the passport. Im just really confused really if what would happen if there friend came back?

I would say they have a stronger argument for keeping her than the owners due to the time they have had her and costs involved. If they had no written agreement saying on loan they have nothing to back up the terms in which their friend kept the horse for them. Hope that makes sense. Am sure have seen an old post similar to this, you might be able to find it but talking a good few months ago!

But I would say I would never buy the horse off the new people that possibly do or do not own it... Not worth the risk the old people might turn up claim ownership and win!

Why don't they just contact the old owner? Maybe they'd sign her over?
 
Just to catch up, does this mean that the people who loaned you Gypsy are still planning to take her back or not? I can't remember, were they planning to sell her?
Short answer is that the people who loaned you Gypsy don't own her, can't sell her, and if they want to then they should really contact her owners to avoid future comeback. The long answer is that, as she's been abandoned with them for so long, if it came to court then it would be an interesting case I think.
If they are planning to sell her from under you I guess your Mum could get in touch with the previous owners to have a chat and see if they would loan her to you, but it could get very complicated and cause all sorts of aggro.
 
I think Galaxy23 is right - this is one only a court could sort out.

Legally the pony remains the property of the freind whose name is on the passport - in no small part becuase if you change ownership you must change the passport details within 30 days or face a fine (if they catch you!).

However the current carer could probably make a convincing case for what is called a lein on the pony given that they have incurred costs and probably increased its value. The legal owners could then repay the relevant costs or sign over the pony.

But in the end this is something which could only really be settled by a court. Which you don't want. If you are trying to buy Gypsy then make every effort to contact the legal owners. If you buy her from someone who does not have the right to sell her you are buying what is legally stolen goods. She could then be taken from you. She would only be legally thiers to sell if they could prove they had made all efforts to contact the previous owners over a number of years. Even then it would be a risk for the purchaser.

In this day of computers, facebook etc it should be possible to trace the legal owner.

As it is dated 2008 and the people you loan from had her for 5 years, and you have had her for 2 more years, she was left with them in 2003?

They probably requested a passport so that they could loan Gypsy out. My horse's passport is dated 2008 too, her last owners got the passport for her. Prior to that I have no idea where she has been.

Have they heard from the real owners since Gypsy was left with them in 2003?

Hey all, sorry I havnt been on to reply.

Well .. I was hoping to buy Gypsy .. but after speaking to the people I loan her off, they said that shes in a sticky situation and can't sell her. Because she hasnt managed to get in touch with her rightful owner .. Gypsys passport was issued in 2008. The name on the passport is the person that I loan her from, and also in the passport nothing has been signed off, so as I got her jabs and everything done I had to sign her passport to say that I am her representive/carer and shes not allowed to go to slaughter etc.

Everything in her passport is what I have got done and signed.

Does anyone know where I could find her rightful owner? Because they won't like it if I try to get in touch with her.

Are they planning to take her from you?
If not I'd be tempted to get a lifetime loan contract signed up, rather than contacting the previous (actual) owner.

There not planning on taking her from me .. but .. basicly they have changed a part of the new loan agreement, and because of this I want to buy Gypsy. As it was over her insurance etc .. because my mum doesnt want me to pay for her insurance incase she has an accident then I end up paying for it all and they give me their 4weeks notice because of the accident leaving me without a pony, and also trying to claim my money back etc.

I completely understand where they owners come from anyways .. why should they pay for the insurance for a pony they don't really see .. So ive written them a letter explaining everything etc. But I also said that I want to buy her, so they don't have to pay for her insurance and I get to take care of everything and then I get my own pony.

But because of this situation she can't really sell her. So its a really odd situation. A horrible one to be in as I don't want her to go. Pleasee don't comment bitchy comments on this because I it is going to be sorted out very soon.

What details do you have for them? Name? Previous address? Place of work?

For her actul owner .. I do not have any contact details for them .. I have no name or anything, I am going to try find out though. Hopefully I shall get somewhere by asking around :S lol x

When you loan a horse you take on the responsibility. You pay the insurance or pay the vet bills. I think your mum is wrong in this situation. You have a horse for free so you foot the bills whilst it is in your care.

I am loaning at the moment and pay the insurance. If the horse needs the vet I/the insurance will pay. It is the responsibility I take

I dont think buying is an issue as the loaner cant sell. You just need to do the best by the pony. Your only other option is to let her go back and buy your own which will be more costly. And horses break.

Okay well .. I don't want bitchy comments thank you .. its something I don't want to get into hence why I hadnt put it on this post untill asked .. Im not going to go into it but its just a long story. I just put this post on here to find more info out .. but thank you very much anyways :)
