ok so il explain the situation first basically where i live is a big massive estate out in the middle of nowhere, where my house is theres a couple of houses then down the hill is another few more smaller houses and our stables are down there which we own plus we own all the surrounding land so as you would when you have 4 horses keep them at our house,

but down the hill theres a couple "the old coffin dodgers" there not really that old but anyway there retired city folk that keep pigeons and stuff and constantly complain about the horses and because of the scottish outdoor access code we cant stop them walking through our fields and then they moan say the horses charged them and the horses stables smell and it goes through the walls to there house (there mucked out everyday at 7am and there not deep littered )

anyway on two occasions mrs coffin dodger has said maybe a gate might get left open basically a threat!

so after this couple tried to go around all the residents to vote horses off the estate saying they were a danger (there the biggest nicest horses ive ever met wouldnt touch a fly ) and everyone basically laughed at them .

mum phoned me today in hysterics crying saying someone had opened the gate and let all the horses out so i ran out of work got home as soon as i could we luckily managed to get the horses in after they had been running about on the road (OMG)

so finally we calmed down i went to B&Q got some big proper chains chained up all the gates , phoned police they cant do anything about it

i know i cant prove it was them but i just know it was


im sooo raging and cant relax keep goin out and checking them all and its the start of my week off and was supposed to be going out tonight

No wonder your raging, I would be fuming and would of gone down there and given them a piece of my mind, which would probably mean it wasnt them and then they would hate me more!!!

At least there chained in now, poor you though

Why can the police do nothing?Surely now gates are padlocked and someone still lets them out they have to do something??Honestly what do they get paid for

OK, deep breath and think again on this. Firstly, if I was in your place, I too would be furious.

So, how about calling say BHS helpline or Citizens Advice - and ask for clarification on the law if someone is seen to have let your horses out? or does your horse insurance have a legal advice line? or maybe someone on the board could advise? there must be some loophole or vague threat that could be brought into play. Armed with that, I would then draft a letter to residents, citing this, and saying steps had been taken, has been registered with the police and that should this happen again, you will take legal action? I could be talking complete rubbish but there must be something you could use on these lines? What about them losing the right to roam if they are proved to be endangering lives (motorists) by wilfully letting your horses out?

Police unlikely to be interested. Some time ago someone cut the 2 padlocked chains off our field gate (which is down a private lane). Cut the wheel & hitch locks off the caravan & stole it. Left the field gate open & the horses got out on the main road - while we were at work. Fortunately a neighbour heard hooves on the road & saw them & managed to catch & return them to field before any accidents. It took police 3 days to come & investigate.

No wonder you are raging, i think I would be having a wee word. What a stupid dangerous thing to do.
It's not only the lives of the horses they are risking. There are some mean and nasty people in the world.

Can't you and your mum go and see them tomorrow and have a polite word? You could say something about the fact that they have threatened to let the horses out in the past and now its actually happened (trying not to be TOO accusing!) and that you have spoken to the police about the incident as it could have caused a major incident for both people and the horses. Might just deter them (if they did have anything to do with it).
 
Padlocks on both sides of gates (so they can't be taken off hinges) might be an idea. Your local BHS person might be able to advise on what you can do (legally) about access?

So pleased your horses are OK :-)

Why not go and say how dreadful it was, risking an accident, someone could have been killed, etc. etc. and DID THEY SEE ANYTHING SUSPICIOUS and please let you know so you can tell the Police. And you have asked the Police to keep an eye on the place.

They might get the message.

Lucio7 Bless her is right, take a deep breathe and get legal advice, if somebody has let your horses out that is a delriberaty act. chain lock everything 4 times if need be, because if they are cut through then it is a malious attack and the police cann't ignore it. And please take photos as the police cann't say there is no evidence about ill intent, if somebody cuts through heavy chains then there is ill intent. Or you could do a walk way through your field with electric fencing so said people couldn't walk where they liked have to stick to said path, on each side of said path, just make sure it's switched on!!!
 
what a nightmare - and it rings a lot of bells with me. We had almost exactly the same situation - neighbours who'd moved out of the city who objected to our horses being on our land because they had a warped, sterile idea of what 'the countryside' was supposed to be like. We had a hilarious moment where myself and my sister turned up at the local council offices for the only time in our lives (to work on a geography project - it was a while ago!) and walked straight into them poring over a map of the land trying to find a way to object to the land usage and field shelter etc. It wasn't funny after that though, it got pretty nasty and to cut a long story short and without wanting to labour the point, I now know they ended up poisoning my horse. I'm not saying this to scaremonger at all, please don't think that, but now I look back and wonder why I didn't do something sooner to let them know we suspected they were up to something. When my replacement horse (yes, that's what happened) started to display symptoms I moved her immediately - so in a way they 'won' by making us move and ruining my mum's dream of having our own horses on our own land. Looking back more than ten years on now, I wish I'd been more proactive at the time and had said something along the lines of the police-related comments suggested above. Part of me couldn't believe someone could be so uncaring and callous, but of course they can. I'm really not trying to sound scary or over-dramatic, but I think you need to nip this in the bud because these people are from another planet. Hopefully the police thing will scare them off? I know exactly the type of people you are talking about. Unfortunately. What on earth do they expect to find in fields? Cuddly toys? What I would do is catch them at it, with evidence. Try to get them to repeat their threats in front of you and a witness. Then insist the police charge them as you are making a complaint. Reiterate that it could cause a road traffic accident with loss of human life. I would also be tempted to bait them, wait hidden outside the said gates, with a witness and catch them in the act. Or film them. You can get movement activated cameras which record onto video. Just train them on your own private land. I wouldn'nt just sit back and do nothing.

Just how often do they walk across your land? Theres always the harassment angle. You are female, they are old men...are they walking there for exercise or to stalk you?

Finally, you can always take out a civil interdict against them appearing on your land. Their threats (with one witness) would probably be sufficient. If they breach this, the appropriate action for the police is to arrest them. Not too expensive either as they usually don't get sufficient notice to defend in court.

Often you have to fight like with like and then they leave you alone. I'm pretty sure a neighbouring farm labouring was puncturing my car tyres when I parked at my yard. Me driving big Mercedes, he, older man having lost his licence for drink driving. 6 punctures in 9 weeks, 2 brand new tyres ruined. I marched round and confronted him in a rage, not accusing him directly but making him clear if my tyres were punctured again he would be the clear suspect and that would only be the beginning of things. Funnily enough I've not had a single puncture since.
 
I am new here, but whenever I hear something about non horse people vandalizing or breaking gates open like what is described here it makes me rageful as well. The lack of equine knowledge of these perpetrators makes them doubly dangerous. My heart goes out to you-those ppl that did this are selfish, immature and cruel in the way they are attempting to express opinions. I admire your restraint by merely labelling them coffin dodgers.

Perhaps the police dont handle such problems but surely there must be some type of cruelty charge for opening a gate with intentions of horses getting onto the road. Perhaps you can lure her back and covertly film it. I hope this is the end of it for you. Sending good vibes from the USA.
 
I can't help but wonder if we would get a different version of events from the other side - this is how neighbour disputes get complely out of hand and end up in court with both sides looking smallmindeded and seriously out of pocket.
Threatening anybody, especially with no proof will solve nothing , neither will trying to involve the police who have better things to worry about.
 
I'd paddlock the gates. Despite the access code you can still do this - particularly if you have recorded a time when it has been deliberately left open. If possible - and i know its a long shot. but try and electric fence around the field away from the hedges. The only of the place I keep my pony caught the neighbour putting metal spikes in the hedges to stop the horses eating them

I'm 100% sure you stables don't smell but even if they do there is absolutely nothing they can do about it. Unless the CAUSE of the smell (not the smell) is directly linked the impacting on human health then that's just tough. Could you imagine if there was a law to control smell - every farmer in the country would be stuffed.

Good luck. Its so horrible when you invest in something which is yours to allow you to do nothing more than pursue your own hobby.

I'm just south of Glasgow - if you want to borrow my pony for a week it will soon show them what a genuine pain in the arse menace a horse can be. might put your into perspective

ok so i just want to keep my horses on my land like i would imagine most would i have never started anything with them and have always ignored there petty little threats about opening gates but when it does really happen its kinda hard not to point fingers i know i have no proof it was them except they were seen by neighbours son walking about the estate five mins before horses were found running about plus i had no intention of threateing them but maybe if police did show up and chap there door and only asked them if they had seen anything might of shook them up a bit because most threats of theres we ignore
 
Bonny you are very right. Neighbour disputes can be more daunting and dangerous than initially realised by those involved. Perhaps a more passive method for obtaining proof would stop the gate openers from getting too emboldened due to repeatedly succeeding with their mischief. Objective proof will allow the problem to be resolved, yet subjective emotionality and speculation will prolong and possibly exacerbate conflict.
 
Like I said before it's hardly a police matter - why not just padlock your gate, forget about what's been said and try and get on with these people - generally works far better in the long run than having a tit for tat childish dispute. I assume neither of you are intending to move so why not make living near each other bearable if nothing else ?
 
Wouldn't be saying that if a person or horse was injured or killed. They need to realise the implications of what they have done (if it was them that did it)
To many people get away with to many things nowadays because no one does anything about it. It's not on and they need to know you won't accept that
 
It's not a matter of accepting it or not - a gate was left open, perhaps an accident perhaps on purpose, there is no way of knowing. Why not simply stop it happening again rather than throwing around wild accusations - nothing else is going to help the situation
 
ok i know it was def on purpose because it was a paddock gate that no1 should be in . plus horses were in the paddock because these people like to go through our other fields for walks at weekend so to try keep them "happy" we move horses on a friday morning ...im sure if it were you, you would be p*ssed off and would prob want to have a rant and would maybe point the finger at someone that was kicking about at the time and had previously threatend to leave gates open i know i have no proof but if im wrong my bad
