Lorry left behind

We run a full livery yard.One of our liveries was recently asked to leave owing to incurring service bills and lorry parking which went unpaid for several months. This was recovered through the liveries deposit and said livery has now gone from our yard .Our problem is they have left a seven and half ton horsebox on our rented (premises)
They have been asked several times to remove it and have now been given a deadline of christmas eve .The lorry is a pile of junk and I'm guessing it's not going to start as they never use it. Just looking for some guidance as to where we go from here .we need the space for other liveries and they are using us as a free storage facility

Unfortunately I don’t think the council will be interested as it is on private land. It was some years ago so things may have changed but we had a tenant who was evicted for not paying their rent. They left a car on the drive. It really infuriated me that by law I had to contact them to say I was going to dispose of it if they did it not collect it by a certain date. We then had to pay to have it taken away ?

You could take them to court over the disposal fees.

If it is SORN, message the owner giving them 24 hours to remove it or you will tow it onto a public highway. At that point they become liable for having an illegal vehicle on the road and will get a fine and/or prosecution.

I'd seek a bit of legal advise, but 7 days notice clearly stating what you will be doing on with the lorry on XXXX day. It might be worth also contacting the police and informing them of the situation and your intentions. (its what i had to do with an abandonment notice I put up)
It will be worth something to someone for parts I'm sure. Even if you get someone to take it away free of charge for the parts.

*** this is by no way intended as a dig**** going forward would it be worth putting a rule in place that all lorries stored on your property must have a valid MOT/plating, tax and Insurance.

^^^ I'm inclined to agree with this advice.

I had a client who left the frame of a Landy on my place plus some tyres from it. It was supposed to be a short-term thing - but they never bothered to come back for it and the frame just became a rusting eyesore, as well as being a PITA as it was in the way.

I later heard that the "client" had moved to quite a long way away, certainly out of the county, and I had no way of contacting them.

It needed shifting! So what I did was ask a scrap-metal merchants if they could assist. They weren't keen on having it however they didn't charge for taking it away but neither did they pay me for it!! But it was got rid of.

The tyres I advertised on local countryside FB pages and they were quickly snapped up! I could've sold them thrice over!

OP I would agree heartily that you do need to get some legal advice and possibly get a solicitor to write a Recorded Delivery letter to your previous livery client saying in legal language that unless the vehicle is moved by a certain date then it will be removed.

Yes it is a PITA having to pay for a Legal but IME you can't be too careful with situations like this if you are a YO as it could quite easily float t!ts-up if you don't do things the right way.

If you are a BHS Gold member you can get free legal advice.
You need to write them a dated letter by Royal Mail Special Delivery advising them that they should remove their lorry within 28 days. Failing that you will charge them £10.00 per day storage and that after a further 28 days you will have the vehicle removed and disposed of and that you will reclaim all the expenses you have incurred from them. (Use the small claims court which you can do on-line.) Keep a copy of all correspondance as you will need it for the small claims court. Good Luck!

Update ...I have contacted the police .DVLA ..citizens advice..council ..No help..I have sent a recorded letter to advise we will be moving it but legally it seems we cant and there is no back up ..if I register it as abandoned it asks if I know the owner which I obviously do and this can be proved .The only option is to go thru the farmer we rent the land from as he doesn't know them ..

Same is happening with a trailer parked at our yard. Been deserted for years although I'm not sure if its being paid for.

My trailer is parked on the end of the row as I struggle with a slope that we have by the parking which means I need space to reverse in and out as I can't use the slope due to the low skirt on my car. I am hoping that I can move the abandoned trailer into my space and I can then park between that and another to keep the worst of the weather off mine a little.

The lorry will probably cost more than the value of it to move it so the old livery is probably hoping the problem will go away if they ignore it long enough. It sounds like your hands are tied sadly.

The rules were changed in 2012 (our abandoned vehicle was years before this).

A ridiculous new ruling.
