Quick question - we had an arena built at home and the planning stipulation is that it is for "Private Use" only.

Now I'm sure I've heard someone say "Private Use" is yourselves and a limited number of "friends/relatives"

Anyone know if this is the case or did I dream it

Don't really know but we've had to stop using someone else's arena relatively recently as they were accused of running a business from it and were being threatened with business rates.

btw you were asking for telegraph poles and I know you found them reasonably cheaply but may I ask where from?
 
You can't charge people to hire it. Whether you allow a friend to ride in it from time to time is another matter I'm sure.
 
private use - strictly interpreted - means that you cannot permit other people from outside the property to utilise the arena at any time

with or without payment
 
That's what I thought - some people we know up the road from us asked last night if they could use it once a week and we said no due to planning issues - felt really bad and wouldn't be charging - she's just got a new horse and having probs schooling it in the field - just felt really bad as it wouldn't bother us!

Telegraph poles we got from Patrick Brothers reclaim at Parson's Drove - think it was £1.50 a foot delivered
 
I think it depends on whether or not you are charging people. Private use is where you let freinds and relatives use the arena without charging. As soon as you charge to let other use the arena it becomes 'business use'. (I think!)
 
I know where our Yard is concerned although it can be used by people who are liveries (we pay £8 a week to be able to use both schools) no one from outside the yard can use it due to planning stipulations. I am not sure what the exact stipulations are though...
 
Problem is we have no spare stables and she keeps it at home with her mums horse!

Will give planning a ring and see what they say - I know someone fairly local who has indoor and outdoor for private use and teaches a few people in them for money (outside people) and she said private use includes family and friends!!!!??? Different council to us though

This is the legally accepted definition - as it has as much to do with increased 'traffic' - beit foot, hoof or vehicular.

We have same stipulation on ours but allowed our neighbour from 'down the lane' to use it occassionally - she was spotted using it during the weekday for an hour or so and we got a letter warning us.....it only takes one person to alert the council and you could be facing enforcement - but then that must always be looked at in the terms of 'whether it is economical or viable for the council to enforce'............
 
Thanks for that - will stick to the no for now - just felt bad as I can understand how hard it is with a new one! They did say about getting her dad to build one
 
council's have all round increased their enforcement teams over the last year (sec. of residents assn so get to know these sort of things)

probability of enforcement is higher now

and if you happen to have people who hate being held up by horses on the road then you will get informed on

it is viable for council to enforce because what they do is to get the neighbours, unpaid, to keep a diary and video evidence of 'breaking the rules'. Then this evidence is used by the council to prosecute the offender

has happened locally to me any number of times in the last year
 
If you apply for planning permission for a menage at home it is important to ask for Personal, use, Familly use and use by friends.

If you are buying an equine property always ask to see the planning permissions that where applied for for the fields, menage, schools and permanent cross country jumps so that you don't end up with any nasty suprises.
 
Seansheep - will stick with the no then before checking - would actually reduce horse trafic on the road as at the moment she is hacking instead! There is lots of horse traffic round us and I really don't think neighbours would mind - not that they can see - but will double check with planning dept before allowing her to use it
 
Appyjude is spot on with this one, I have been through it on several occasions. If you get permission for a private house/yard to build a menage then only you personally can use it. If a livery yard gets permission & they are a legitamate business ie: paying business rates they can allow resident liveries use of the arena. If you are a commercial riding centre then you can hire out to outsiders providing that is what you applied for in the planning permission & it was granted.
